7 Mustangs Run to Death by US Govt- More Brilliant Science Based Decision Making

edit. v2.

______________________________________

You can tell it’s an election year by the amount of wild horses that suddenly have to be removed off Federal range to “preserve habitat” for mule deer hunters and cattle ranchers who also lease it.   This year, 1200 in our sister state, home to the Senate Majority Leader.

The Obama administration touted that it would use so called “science based” decision making.  After watching the Bush administration decide to humor the National Park’s decision to murder a bunch of introduced, very cute, but non trophy type smaller deer at Pt Reyes National Seashore with helicopter hunting, (think more canned Tule Elk Special Hunts as a result ) under the guise of they weren’t “native,” and the helicopter contract went to a big Republican donor, while the Dems made stupid excuses for this, I was sort of cynical that this was going to happen.

Science does not = rotor cowboys.

Science does not = Cattoor Livestock.

http://rtfitch.wordpress.com  7/12/2010 BLM – Infamous helicopter contractor returns for illegal tuscarora wild horse roundup.  “It was Cattoor Livestock that stampeded the horses of Pryor Mountain in 95º+ degree heat for miles, and again the Cattoors who were actually credited with running the hooves right off from several foals during the bloodiest of all roundups on record, the Calico Complex debacle.  Due to the deaths in the field, …. documented on video, the Cattoors launched an attack on the First Amendment and instructed their attorneys to issue threat/demand letters to news agencies, major non profits, magazines and blogs that were reporting the news to the public on the deadly Calico roundup.  The letters wanted to “fix” the news…. and insist on public apologies for reporting the facts as witnessed. The mention of company owner David Cattoor’s past indictment for capturing and selling wild horses to slaughter was likewise considered taboo. ”

“In their care, 86 horses have died and 40 mares have aborted their late term foals….”

http://tuesdayshorse.wordpress…

“In late December, government contracted helicopters took to the air, rounding up every horse they could find on the vast 500,000 acre Calico range, an area designated principally for wild horse use since 1971, but grazed by thousands of privately owned, government subsidized cattle. The roundup….. has cost at least $1.3 million…. while causing injury and death to hundreds of wild horses.  ….. over 24 million acres have been withdrawn from wild horse and burro use.  The BLM “welfare ranching” practices continue allowing the land to be leased primarily to corporations at minimum fees of $1.35 per cow/calf pair or per 5 head of sheep per month, along with land leases to extractive and energy industries on Western public lands.

Feinstein Feeding Right Wing Myth of Unemployed Enjoying No Jobs After Senate Vote

The Democratic Party holds the majority in the Senate, but increasing forgets why it exists, as it continues to enact the disaster capitalism scenario of a major party which screws over it constituents.

Today (Wed) the Senate voted against extending expired unemployment benefits, with 11 useless Democrats voting with the Republicans to increase human misery.   Oh, and Plantation Blanche Lincoln of Arkansas, who just squeaked by in a Democratic primary because of her No Public Option health care stance ?   She couldn’t be bothered to vote at all.  http://www.senate.gov/legislat…      Senate Vote #190 motion to agree with House amend. to Senate amend.  American Workers, State, and Business Relief Act of 2010

At least people like Senator “He’s with us on everything but the war” Lieberman don’t pretend anymore.  He was a NO.  So were:

Senate Gives a Hearty F-U to Unemployed, Hungry & Sick, Breaks Early for Vacation

The Senate broke early, this past Thursday,  for their 11 day long vacation, kicked off with the Memorial Day Holiday upcoming on Monday.   They aren’t coming back into session until June 7 th.   They can’t “do” anything because of their arse kissing fillibuster rules until June 11th, 15 days after that.

HuffPo.  You need to read the entire story, but here’s a taste:

http://www.huffingtonpost.com/…

On June 1, several programs, including extended unemployment benefits, will expire. By the end of the week, 19,400 people will prematurely stop receiving checks, according to data from the Department of Labor. How long will it take the Senate to finish the bill? With Republicans promising to stand in the way, leadership will need to file at least one time-consuming “cloture” motion to break the filibuster and to set up a vote by the end of the week in the best-case scenario. By the end of the following week, the number of premature unemployment exhaustions will climb to 323,400. The week after that, 903,000. By the end of the month, 1.2 million.

It will be the third time this year that lawmakers have allowed extended unemployment benefits to lapse, and the second time they’ve decided to leave town for recess fully knowing the lapse would cause panic and confusion among blameless layoff victims — not to mention what Katz calls a “huge” administrative burden on state workforce agencies.

But this is the first time the Democratic Party can’t even half-plausibly blame the Republicans for the lapse. “This isn’t being done because of Republicans, believe me.  This is done because there’s a group of us, we don’t have a majority, but they listen,” said Rep. Dutch Ruppersburger (D-Md.), who fought to shrink the size of the bill. “I think it’s really symbolic. We have a very diverse party and the party has come together… This is a real victory for the moderates and the Blue Dogs and the freshmen, that our party leadership is working with us to let this happen.”

The difference between the Blue Dogs and the Progressive Caucus, as I have repeatedly pointed out, is that the Blue Dog contingent is already a sell out to the established domestic energy, pharma, and tobacco industries, from which it takes donations, and said industries also are the financial backers of the Tea Party movement, which is the Republican Party’s astroturf for non thinking, feel good libertarian type older voters already on government benefits.

The House sucked up to the Blue Dog contingent to get their version ready for the Senate, and the Senate, as usual, skeedadled out the door, without taking any action on it,  laughing at them again.   The House also just left the entire month of December 2010 out of the bill, so the budget “deficit hawks” in the flyover states, like Sen. Kent Conrad  (D, ND, Middle East Warmonger, Domestic Budget “hawk”) can look at it again.

“It’s so hard to know what the economic conditions will be at that point,” he said.

Remember that “health insurance reform” bill these clowns just passed with great fanfare a few months ago ?

They are cutting the unemployed COBRA’s benefits, too.  Any person laid off after this Monday, May the 31st, will not be able to get COBRA subsidies to continue to purchase health insurance.  Welcome to the open market and the Emergency Room, folks !

Climate: Graham’s Immigration Hissyfit Threatens Energy Bill, Kerry Delays Debut

Senator Lindsey Graham(R, SC) has dutifully assumed his cloak and dagger as the Village Villain du Jour, thrown a last minute hissyfit on the Saturday before Sen. John Kerry was to reveal the long anticipated Climate and Energy Bill on Monday, and is holding his breath and threatening to turn beet red unless the Senate ignores the immigration issue this year.   http://thehill.com/blogs/e2-wi…

The support of Graham was sought because it was assumed that of Senators Ben Nelson(D, Mutual of Omaha) and Blanche Lincoln(D, Walmart of Bentonville) would not automatically be forthcoming, after their performances during the health insurance bailout bill which was passed earlier this spring.

Now Graham is petulant, on cue, after the Arizona state legislature went neo Nazi on the Hispanic and Latino voter demographic, and the Arizona governor signed the law yesterday mandating proof of residency be shown on demand to police.  Graham says his confidence is “destroyed” that the Senate would be able to multi task on 2 topics during the rest of the year.

Hurrah!

THE WEEK IN EDITORIAL CARTOONS

This weekly diary takes a look at the past week’s important news stories from the perspective of our leading editorial cartoonists (including a few foreign ones) with analysis and commentary added in by me.

When evaluating a cartoon, ask yourself these questions:

1. Does a cartoon add to my existing knowledge base and help crystallize my thinking about the issue depicted?

2. Does the cartoonist have any obvious biases that distort reality?

3. Is the cartoonist reflecting prevailing public opinion or trying to shape it?

The answers will help determine the effectiveness of the cartoonist’s message.

Here’s the DCCC talking points & plan for h/c vote

Since the Democrats intend to actually vote on the health insurance bail out next week, now that Speaker Pelosi has repeated that the Public Option is Off of Our Table, and said,

“I’m quite sad that a public option isn’t in there. ”

http://tpmlivewire.talkingpoin…

Sad in the Baby Seal Syndrome way, as she also said she was for single payer, herself  (eyeroll icon øø),

….   they’ve sent out a memo with the schedule (try not to laugh too hard at the thought of the them sticking to one) and some talking points for Congresspeople to take back to their districts during the Easter vacation.   They also told the members to just shut up on reconciliation:

http://www.politico.com/news/s…

http://www.politico.com/livepu…

“At this point, we have to just rip the band-aid off and have a vote – up or down; yes or no?” the memo said. “Things like reconciliation and what the rules committee does is INSIDE BASEBALL.”

“People who try and start arguments about process on this are almost always against the actual policy substance too, often times for purely political reasons.”

I take it they are going to do everything in their power to prevent just that – an up or down vote – from occurring with the Senate and the Public Option, so look for Sen. Bernie Sanders’ proposed amendment to mysteriously and quietly vanish into the ether.

The Patriot Act Extension Backstory

The Bill of Rights

Fourth Amendment – Protection from unreasonable search and seizure.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The Patriot Act was extended for another year this week.  Read this information about it from the ACLU:

http://www.aclu.org/national-s…

Late last year, to avoid expiration on December 31, 2009, Congress extended the provisions through February 28, 2010. Despite bills pending in both the House and the Senate to amend the three expiring provisions and other sections of the Patriot Act, Congress decided instead to move ahead with a straightforward reauthorization.

Since the Patriot Act’s passage in 2001, there have been several consecutive reports (including one released in January) from the Department of Justice Office of the Inspector General that have outlined widespread and blatant abuse of the statute. FBI agents routinely claimed false terrorism emergencies to use “exigent letters,” or emergency letters, in order to gain private records for investigations when no emergency existed. The FBI also regularly issued NSLs after the fact in an attempt to legitimize the use of exigent letters. Even after today’s vote, there remain bills pending in both the House and Senate that were specifically introduced to narrow the scope of the NSL statute.

Removing Health Insurance’s Antitrust Exemption — will Lower its Cost

With all the other HCR news, you may have missed this important tidbit. (I know I did.)

House Votes To Repeal Antitrust Exemption for Health Insurance Firms

Thursday, February 25, 2010

On Wednesday, the House voted 406-19 to end a 65-year-old antitrust exemption for health insurance companies, part of Democrats’ broader strategy to revive their health reform efforts ahead of Thursday’s bipartisan health care summit, Roll Call reports (Dennis, Roll Call, 2/25).

The bill (HR 4626) would amend the 1945 McCarran-Ferguson Act, which exempts insurers from federal antitrust law if they are regulated by the states.

Granted it’s NOT the Public Option, BUT still it’s important to finally putting the brakes on the run-away rising costs of Health Care, hopefully

Hill: Reid Lacks Jobs Bill Cloture Vote

Yesterday, I reported on the incredulous national reaction fellow Democrats had to Senator Dianne Feinstein’s (D, CA) proposed amendment to the upcoming Jobs Bill, the one where she wanted to suspend the Endangered Species Act protections to migrating baby salmon and Delta smelt in the Sacramento & San Joaquin River Delta, with the excuse that increased water pumping out of the Delta to her billionaire water broker donors would “increase jobs.”

This ignored the fact that the salmon fishing season has been suspended the past 2 years on the CA coast and may be heading for a 3rd year of cancelation because of the collapse and crash of the salmon population.

Story here:

DiFi Does a Pombo on Salmon, Jobs Bill Amend Guts EndSpecAct

I found a letter from CA Assemblyperson, Chair of the “Water, Parks, & Wildlife Committee,” Jared Huffman, to Mark Corwin, Director of the CA Dept of Water Resources (DWR) from 1 week ago, Feb 10th.  In it, Chairman Huffman asks why the CA Dept of Water Resources (DWR)  is flouting the CA Endangered Species Act (CESA) with regards to Judge Oliver Wanger’s opinion Feb 5, 2010, that Delta water pumping extraction must decrease to protect Delta Smelt and migrating salmon.  In 2008 and 2009, the US Fish and Wildlife Service and the National Marine Fisheries Service said that if water agencies such as CVP + SWP pumped high amounts of water out of the Delta at certain times, it was going to drive Federally listed endangered fish in the Delta to extinction. (state rules need to comply with Federal listings)  In the summer of 2009 the Dept of Water Resources requested rules clarification, then turned around and started attacking the new rules in court.

Huffman  to DWR:

{{{   On August 3, 2009, (the CA)  Dept Water Resources (DWR) filed legal papers in support of a motion

by its water contractors seeking to invalidate the biological opinion – even though the effect would

be to invalidate DWR’s own CA Endangered Species Act coverage for the SWP pumps.

Then DWR took aim at the salmon biological opinion.  Last week, detection of salmon triggered an

obligation under the salmon biological opinion for the SWP/CVP pumps to reduce reverse flows in Middle

and Old Rivers.  State and federal water contractors went to court seeking to overturn the heavily peer

reviewed salmon biological opinion and replace it with a previously invalidated Bush-era opinion.

Now, detection of smelt has triggered protections under the delta smelt biological opinion. As you know, a limitation on reverse flow to protect delta smelt would also meet your requirements to protect salmon and longfin smelt.  Monday, Central Valley Project contractors filed for a Temporary Restraining Order on the delta smelt protections.  And Dept of Water Resources, fully informed as to the deference the court gave its last letter, filed another “non-opposition” letter yesterday.

Having actively worked to create these problems, please explain how DWR intends to fix them.  }}}

______________

a pdf download of Huffman’s letter to the DWR is here:

http://www.lloydgcarter.com/fi…

I expanded some of the acronyms above, so it would read more easily

I’m quoting this to to help illustrate the breadth of the problem Senator Feinstein created with so many levels of both state and Federal water and fisheries law, when she decided to play Top Water Distributress of the SacJoaquin Delta. The state of CA was trying to work this out with the Federal government, and she meddled to make a favor to Kerns County water brokers, and Westlake Mutual Water Company and billionaire donor Stewart Resnik, so they could sell a bigger water allotment to the highest bidder in Southern CA.  And this is going to be tacked on to a JOBS Bill.

Congress has had this week off because of President’s day. They had the previous week off because of 2 massive snowstorms.  So they’ve had plenty of time to interact people who are either mad at them or wish to purchase their influence.

Today, The Hill is reporting that Majority Leader Senator Harry Reid doesn’t have the cloture votes to even begin debate on the jobs bill.
