About those New EPA Dispersant Tests

Perhaps you heard about the recent EPA Press Release, regarding latest Toxicity Testing results for Dispersants.   Depending on which sound bite you heard, it almost sounded like Corexit got a clean bill of health.

Confused?  I was too.   And since I had previously written a well-received diary,

which dove into the Toxicity Data, that the EPA originally cited as credible only 2 months ago, I figured I should try to figure out what was up with the ‘New and Improved’ Dispersant Testing.

What follows is my assessment of what’s happening now, including some relevant links.

I’ll try to keep it brief. (I hate long diaries, lol)

Whistleblower says that BP Spending Millions to Cover up Spill Instead of Clean it Up (UPDATED)

Something we have all suspected as being true is now being admitted publicly by a whistle-blower.

“In a shocking interview with CNN’s Anderson Cooper on June 29th, Allegiance Capitol Corporation V.P. Fred McCallister said that BP is deliberately sinking oil with the toxic chemical disbursant Corexit, to hide the size of the oil spill. By sinking the oil before it can be collected, BP won’t have to pay fines on it.

McCallister said, “Everybody in Europe, where the standard practice is to raise the oil and collect it, is scratching their heads, and quite honestly laughing at what’s happening in the Gulf.” He added, “Everyone is looking at us and wondering why we’re allowing this to happen.”

Hurricane Alex, with winds of up to 100km an hour, is hampering efforts to clean-up the oil spill in the Gulf of Mexico. The state department has welcomed help from 12 countries offering to assist with the clean-up. And there has been a rare offer of support from an indigenous community from Ecuador for another indigenous tribe in Louisiana that has been affected by the spill.

Al Jazeera’s Scott Heidler joined the Ecuadorians in Louisiana’s Bay Baptiste. They underwent a long and tough journey in a boat to visit the oil-tained wetlands.

BP’s Well May Leak For 55 Years Or More Into The Gulf Of Mexico?

On June 15, 2010 the US Department of Energy announced that a group of federal and independent scientists convened by Secretary of Energy Steven Chu, Secretary of the Interior Ken Salazar, and Chair of the National Incident Command’s Flow Rate Technical Group (FRTG) Dr. Marcia McNutt (Director of the U.S. Geological Survey) had developed a new estimate for the amount of oil gushing from the ruptured well in the Gulf of Mexico that indicated the leak could be spewing up to 2.52 million gallons of crude oil per day into the waters of the Gulf of Mexico from British Petroleum’s Macondo Well.

“This estimate brings together several scientific methodologies and the latest information from the sea floor, and represents a significant step forward in our effort to put a number on the oil that is escaping from BP’s well,” said Chu, who then expanded with “As we continue to collect additional data and refine these estimates, it is important to realize that the numbers can change.  In particular, the upper number is less certain – which is exactly why we have been planning for the worst case scenario at every stage and why we are continuing to focus on responding to the upper end of the estimate, plus additional contingencies.”

Estimates from both BP and from the US Government of the amount of oil gushing from the blown out wellhead on the gulf seabed have been almost continually revised upwards since the well blowout and leak began on April 20, with widespread suspicions that BP has deliberately understated the leak rate in attempts to limit liability for the company.

It now appears that Chu may have been somewhat prescient with his statement that “it is important to realize that the numbers can change”, and that the estimate of oil leaking into the Gulf of Mexico may need to be increased again, since an undated internal BP document (.PDF) obtained by Chairman of the House Select Committee on Energy Independence and Global Warming Congressman Ed Markey (D-MA) was released by Markey on Sunday June 20 showing that BP’s own internal analysis believed that a worst-case scenario, based on damage to the well bore, could result in a leak rate from the well of 55,000 to 100,000 barrels of oil per day.

I guess most of us thought that the $20 billion fund to be set up by BP was to be used exclusively for payment of claims to coastal workers and businesses.  

Michael Rozen, a partner in the Feinberg Rozen law firm, which is in charge of administering the fund. . . . .

“My present understanding is … that it is available for all manner of costs,” Rozen said, stressing that all legitimate claimants would be paid.

“Twenty billion maybe isn’t sufficient for the mass of stuff that’s aired, in which case BP will have to add more. If that should be the case, people still have their rights and remedies under law.”

. . . . . Robert Kennedy, an environmental lawyer and activist, told Reuters that it was another “subterfuge by BP.”

Toxic tort lawyers Mike Papantonio and Perry Weitz said news that the fund can have other purposes “amounts to a trick,” because the public expects all of the money to go to victims.

“Imagine if BP uses a significant portion for clean-up costs,” Weitz said at the spill litigation conference. “What’s left for the victims?”  (emphasis mine)

 

Unexpected Environmental Alliances Amidst The Oil Spill: ‘Jesus Will Rip Your Head Off’

In the wake of the BP disaster, we’ve heard powerful stories from fishermen whose livelihoods may have been destroyed for decades or longer. However long it takes for the Gulf’s fish, oyster and shrimp harvests to recover, those who’ve made their livelihoods harvesting them will need to create a powerful common voice if they’re not going to continue to be made expendable. A powerful model comes from Seattle and Alaska salmon fisherman Pete Knutson, who has spent thirty-five years engaging his community to take environmental responsibility, creating unexpected alliances to broaden the impact of their voice, and in the process defeating massive corporate interests.

“You’d have a hard time spawning, too, if you had a bulldozer in your bedroom,” Pete reminds us, explaining the destruction of once-rich salmon spawning grounds by commercial development and timber industry clearcutting. Pete could have simply accepted this degradation as inevitable, focusing on getting a maximum share of dwindling fish populations. Instead, he’s gradually built an alliance between fishermen, environmentalists, and Native American tribes, persuading them to work collectively to demand that habitat be preserved and restored and to use the example of the salmon runs to highlight larger issues like global climate change.

The cooperation Pete created didn’t come easily: Washington’s fishermen were historically individualistic and politically mistrustful, more inclined, in Pete’s judgment, “to grumble or blame the Indians than to act.” But together, with their new allies, they gradually began to push for cleaner spawning streams, rigorous enforcement of the Endangered Species Act, and an increased flow of water over major regional dams to help boost salmon runs. They framed their arguments as a question of jobs, ones that could be sustained for the indefinite future. But large industrial interests, such as the aluminum companies, feared that these measures would raise their electricity costs or restrict their opportunities for development. So they bankrolled a statewide initiative to regulate fishing nets in a way that would eliminate small family fishing operations.

At present, oil saturates the Gulf Stream.  An official six-month cessation of permits for new drilling did not actually affect the industry or government decisions.  Despite Moratorium, Drilling Projects Move Ahead.  To explain such an authorization and waiver, the Department of the Interior and the Minerals Management Services Division which regulates drilling, pointed to public statements by Interior Secretary, Ken Salazar.  He did not intend to forbid all first cuts in the Earth’s crust.  Absolutely not.  The Federal Government approved wells off the coast of Louisiana in June. Regardless of the day, or realities that are anathema to our citizenry, little has truly changed.  Today, just as in yesteryear, we, the people of the United States of America, in order to form a more perfect Union, polish policies to appear as though our civilization would wish to protect and defend all beings, equally.  

Is BP’s Blow Out Preventer Falling Off The Well Pipe?

After a video was released on June 13th recorded from BP’s underwater Viking Poseidon ROV 1 operating in the Gulf of Mexico near the blown out Macondo Well site showing what appeared to be oil leaks from gulf seabed cracks around BP’s well site, it seemed that it would be only a question of time before an oil saturated gulf seabed turning to wet slippery jello would no longer have the structural strength to support the weight of BP’s large steel 450 ton Blow Out Preventer (BOP) apparatus sitting on top of the well pipe projecting from that seabed.

Republicans Intervene In Traffic Accident, Call Settlement “Shakedown”

Brighton, Colorado (FNS)-Attorneys from the Republican Study Group (RSG) descended upon the 17th Judicial District courtroom of Judge John T Bryan today to present an amicus brief and associated oral arguments in order to prevent a settlement in a lawsuit related to an automobile accident in this Colorado city.

The intervening attorneys claim the settlement reached between the two parties to the accident is a “shakedown” because the plaintiff had not yet exhausted all possible legal remedies when the agreement was finalized, and because the agreement was executed in the presence of the plaintiff’s brother, a well-known local attorney.

They hope Judge Bryan will decline to approve the settlement in today’s hearing, and that he will order the parties to move forward to trial.

“What we have is government transferring property from one party, an admittedly unattractive one, to others, not based on preexisting laws but on decisions by one man, a car czar”, said Crush Mimbaugh, attorney for the RSG, “and we are here today to protect all Americans from this legally sanctioned rape of an innocent driver.”

Oil Rain In Louisiana?

Qualification: I have no way of knowing if that video is of a current event or if it is raining in the video scenes. Although I suspect undecomposed oil is probably too heavy to evaporate, I think that strong storms (hurricanes, etc) can probably physically transport crude oil and spread it inland, and I would imagine that some of the products of chemical breakdown of oil, and reaction products between oil and corexit, the dispersant BP is using, can evaporate and produce toxic rain. Some of those reaction products I imagine might cause ‘rainbow’ slicks on streets like what is shown in the video.

Crude oil contains the powerful cancer-causing chemicals benzene, toluene, heavy metals and arsenic.

Clean-Up Worker Alert!

This is not really a diary, folks!  But it’s an important action alert (also, cross-posted at Firefly-dreaming).

Please everyone, take a moment to sign FireDogLake’s petition to BP insisting they provide respirators and the proper equipment for the clean-up workers along the Gulf coast.  BP is threatening to fire anyone who wears their own bought masks or whatever — seems BP is worried about its PR image (WTF?).

It seems to me that OSHA should be on BP’s back to get them to buy the proper safety and health equipment for these people, who are exposed to many dangerous illnesses!  But, then, it seems to me . . . . . a lot of things . . . . . . !
