Joby Warrick at The Washington Post has an article today confirming what many of us have suspected for some time: the CIA asked for and received written approval for its “enhanced interrogation” program, which notoriously includes the use of techniques like waterboarding. Condoleezza Rice confirmed in hearings before the Senate Armed Services Committee last month that she and other White House “Principals” had been briefed on the CIA’s torture program in early 2002. (ABC News had broken the story first, last spring.)

According to Washington Post article today, CIA director George Tenet pushed for the written confirmations of support, wary of legal entanglements for CIA personnel involved in the abusive interrogation program. He first asked and received the CIA’s get-out-of-jail card in June 2003, and then again after the Abu Ghraib story broke in mid-2004.

For the first time, a senior Bush administration official has admitted to discussing the use of torture by the CIA.

In a written statement to the Senate Armed Services Committee, Secretary of State Condoleezza Rice acknowledged that in 2002 and 2003, she and other high-ranking White House officials discussed the use of torture, including waterboarding, and other coercive methods.

Rice’s and her legal council’s statements were released by Sen. Carl Levin (D-MI), the committee’s chairman. No specific dates were given.

At the time of the White House torture planing meetings, Rice was George W. Bush’s National Security Advisor. According to the Los Angeles Times, Rice admits Bush officials held White House talks on CIA interrogations, she and other White House officials “discussed simulated torture techniques that elite U.S. soldiers were subjected to as part of a survival training program”.  

The Election Committee of the American Psychological Association announced today that the referendum of APA members, in regards to prohibiting psychologist participation in settings where human rights violations take place, has passed with almost 60% of the vote. The total vote, which took place by mail ballot and closed officially on September 15, exceeded the total number of votes cast in the 2005 and 2007 APA presidential elections, and recent by-law votes. The vote turnout clearly indicates a great deal of interest in the interrogations issue by the membership.

The vote for the referendum represents an important victory for anti-torture, civil liberties forces, both inside and outside the APA. Dan Aalbers, one of the authors of the referendum text, and who along with psychologists Ruth Fallenbaum, Brad Olson, and Ghislaine Boulanger, was one of the members of Psychologists for an Ethical APA who worked hard to secure the measure’s passage, in a phone interview called the vote “a decisive victory…. Now we have to work to ensure that APA bows to the will of its members.”

Nothing is more wrenching, more emotionally volatile than the story of prisoners of war, no matter what the country or the cause: the torture they endure (or endured), and the mind-numbing horror of contemplating the inhumanity of those who do the torturing. McCain is playing on his torture history as POW in his run for the presidency. On Tuesday night at the Republican National Convention in St. Paul, also-ran former Senator Fred Thompson gave a speech lauding McCain, and describing the suffering of the GOP presidential nominee when he was held as a prisoner by the North Vietnamese from 1967-73.

There is much that could be made of the lies, exaggerations, and ordinary political mischief in Thompson’s speech. But one big lie stood out. In his narration of McCain’s torture story, he changed one important fact. And since it bears on the larger question as to whether torture “works,” it’s worth mentioning here.

In his speech, Thompson said the following:

Osama bin Laden's personal driver and bodyguard, who made the magisterial sum of $200 per month, 34-year-old Salim Ahmed Hamdan, who was held years without charges at Guantanamo Naval Base prison, has just been found guilty of lesser charges in the first of a series of planned “military commission” trials by the Bush Administration. Comprehensive news coverage of the Hamdan trial can be found at the Miami Herald.

Hamdan was found not guilty on two counts of conspiracy to foment terrorism in league with Al Qaeda. He was found guilty on five of eight charges of providing material support to terrorists. He has yet to be sentenced, and faces possible life imprisonment. In any case, the Bush Administration has already said that whatever the verdict or sentence, no “enemy combatant” will be released until the “war on terror” is over, i.e., until hell freezes over.

Ex-CIA high official Victor Marchetti wrote:

“A ‘limited hangout’ is spy jargon for a favorite and frequently used gimmick of the clandestine professionals. When their veil of secrecy is shredded and they can no longer rely on a phony cover story to misinform the public, they resort to admitting – sometimes even volunteering – some of the truth while still managing to withhold the key and damaging facts in the case. The public, however, is usually so intrigued by the new information that it never thinks to pursue the matter further.”

Scott Shane’s New York Times article, China Inspired Interrogations at Guantánamo (7/2/08), details the use of Albert Biderman’s “Chart of Coercion” by members of the the military’s Survival, Evasion, Resistance, Escape program, or SERE, program to teach torture techniques to interrogators. The article is a fine example of how to conduct a limited hangout, or selected revelation, of intelligence-related material. Its headline and story is disingenuous or betrays ignorance. The aim of the article is to demonstrate the nefariousness or deviance of those who taught SERE techniques to U.S. interrogators, and to hide the truth about the derivation of those techniques, and to the history of the their use by U.S. government agencies.

The Senate Armed Services Committee will be holding hearings into the treatment of detainees in U.S. custody. Tomorrow is part one, as Senator Levin’s committee looks into the origins of U.S. aggressive interrogation techniques. A new article by AP makes clear that these techniques were approved at the highest levels, and that the resulting torture revelations were not due to the actions of a few “bad apples.”

Also, on Wednesday, the House Judiciary Committee is holding a hearing entitled “From the Department of Justice to Guantanamo Bay”, which is the second part of its inquiry into administration lawyers, like John Yoo, and their role in writing and approving torture and guidelines for abusive interrogation.

Meanwhile, Human Rights First has a petition up, demanding that Congress ask William Haynes, former General Counsel to the Department of Defense – who “once advised the Bush Administration that waterboarding and death threats were ‘legally available’ options” – tough questions, bearing upon his culpability for implementing a U.S. torture program.

What happens when the checks and balances of our government are compromised, and justice is undermined?

What happens when the most criminally corrupt group of criminals rule with nearly complete control of the Executive, Legislative and Judicial branches of government for nearly two full Administrations, and the media fails to oppose, to challenge and to expose them?

Criminal malfeasance. Negligence. Dereliction of duty. Failure — multiple failures: failure to uphold the law, failure to act, failure to uphold the duty and responsibility of office.

Actively undermining the just due process of the law and Constitution. Actively interfering with the proper operation of government.

War crimes.

Eight years of crimes, unaccountable to anyone and protected by the entire Republican party — and Joe Lieberman.

The UK Guardian is reporting the United States is holding hundreds of detainees from its international wars on at least 17 “floating prisons” in different harbors around the world. The detainees are interrogated, and then many of them sent via extraordinary rendition to other countries for further interrogation and torture.

According to research carried out by Reprieve, the US may have used as many as 17 ships as “floating prisons” since 2001. Detainees are interrogated aboard the vessels and then rendered to other, often undisclosed, locations, it is claimed.

Ships that are understood to have held prisoners include the USS Bataan and USS Peleliu. A further 15 ships are suspected of having operated around the British territory of Diego Garcia in the Indian Ocean, which has been used as a military base by the UK and the Americans.
