On this day in 1775, Patrick Henry voices American opposition to British policy

During a speech before the second Virginia Convention, Patrick Henry responds to the increasingly oppressive British rule over the American colonies by declaring, “I know not what course others may take, but as for me, give me liberty or give me death!” Following the signing of the American Declaration of Independence on July 4, 1776, Patrick Henry was appointed governor of Virginia by the Continental Congress.

Patrick Henry (May 29, 1736 – June 6, 1799) was an orator and politician who led the movement for independence in Virginia in the 1770s. A Founding Father, he served as the first and sixth post-colonial Governor of Virginia from 1776 to 1779 and subsequently, from 1784 to 1786. Henry led the opposition to the Stamp Act of 1765 and is well remembered for his “Give me Liberty, or give me Death!” speech. Along with Samuel Adams and Thomas Paine, he is remembered as one of the most influential exponents of Republicanism, promoters of the American Revolution and Independence, especially in his denunciations of corruption in government officials and his defense of historic rights. After the Revolution, Henry was a leader of the anti-federalists in Virginia who opposed the United States Constitution, fearing that it endangered the rights of the States, as well as the freedoms of individuals.

American Revolution

Responding to pleas from Massachusetts that the colonies create committees of correspondence to coordinate their reaction to the British, Henry took the lead in Virginia. In March 1773, along with Thomas Jefferson and Richard Henry Lee, Henry led the Virginia House of Burgesses to adopt resolutions providing for a standing committee of correspondents. Each colony set up such committees, and they led to the formation of the First Continental Congress in 1774, to which Henry was elected.

Patrick Henry is best known for the speech he made in the House of Burgesses on March 23, 1775, in Saint John’s Church in Richmond, Virginia. The House was undecided on whether to mobilize for military action against the encroaching British military force, and Henry argued in favor of mobilization. Forty-two years later, Henry’s first biographer, William Wirt, working from oral testimony, attempted to reconstruct what Henry said. According to Wirt, Henry ended his speech with words that have since become immortalized:

“Is life so dear, or peace so sweet, as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take; but as for me, Give me Liberty, or give me Death!”

The crowd, by Wirt’s account, jumped up and shouted “To Arms! To Arms!”. For 160 years Wirt’s account was taken at face value, but in the 1970s historians began to question the authenticity of Wirt’s reconstruction.[8] Historians today observe that Henry was known to have used fear of Indian and slave revolts in promoting military action against the British, and that according to the only written first-hand account of the speech, Henry used some graphic name-calling that failed to appear in Wirt’s heroic rendition.

In August 1775, Henry became colonel of the 1st Virginia Regiment. At the outset of the Revolutionary War, Henry led militia against Royal Governor Lord Dunmore in defense of some disputed gunpowder, an event known as the Gunpowder Incident. During the war he served as the first post-colonial Governor of Virginia and presided over several expeditions against the Cherokee Indians, who were allied with the British.

Henry lived during part of the War at his 10,000-acre Leatherwood Plantation in Henry County, Virginia, where he, his first cousin Ann Winston Carr and her husband Col. George Waller had settled. During the five years Henry lived at Leatherwood, from 1779 to 1784, he owned 75 slaves, and grew tobacco. During this time, he kept in close touch with his friend the explorer Joseph Martin, whom Henry had appointed agent to the Cherokee nation, and with whom Henry sometimes invested in real estate, and for whom the county seat of Henry County was later named.

In early November 1775 Henry and James Madison were elected founding trustees of Hampden-Sydney College, which opened for classes on November 10. He remained a trustee until his death in 1799. Henry was instrumental in achieving passage of the College’s Charter of 1783, an action delayed because of the war. He is probably the author of the Oath of Loyalty to the new Republic included in that charter. Seven of his sons attended the new college.

Anne Hutchinson, Religious Freedom, Activist

Recently, I was driving along the Hutchinson River Parkway to pick up a friend who was in town and meet up with another friend for dinner in the area. It was a lovely warm evening and during the the drive we talked about the historic significance of the region. Dinner was fun and after dropping my friend at his hotel, I followed my usual route back to NYC that closely hugs the Hutchison River as it winds through the Bronx. As I was preparing my daily open thread, On This Day In History, I came across this Wikipedia entry for Anne Hutchinson for whom the river and parkway are named:

1638 – Anne Hutchinson is expelled from Massachusetts Bay Colony for religious dissent.

Anne Hutchinson (1591-1643) was one of the most prominent women in colonial America, noted for her strong religious convictions, and for her stand against the staunch religious orthodoxy of 17th century Massachusetts. She was a Puritan whose religious ideas were at odds with the established Puritan clergy in the Boston area, and her popularity and charisma created a schism in the Boston church which threatened to destroy the Puritans’ religious experiment in New England. Creating the most challenging situation for the ruling magistrates and ministers during her first three years in Boston, she was eventually tried and convicted, then banished from the Massachusetts Bay Colony with many of her followers. [..]

In 1634, after the birth of her 14th child, Hutchinson followed (John) Cotton to New England with her husband and 11 living children, and soon became well established in the growing settlement of Boston, in the English colonies. She was a midwife, and very helpful to those needing her assistance, as well as being very forthcoming with her personal religious opinions and understandings. Soon she was hosting women at her house once a week, providing commentary on recent sermons, and sharing her religious views, including criticism of many local ministers. These meetings became so popular, that she soon began offering meetings to men as well, to include the young governor of the colony, Harry Vane, and over 60 people a week were visiting her house to learn from her interpretations and views of religious matters. As a follower of Cotton, she espoused a “covenant of grace,” while accusing all of the local ministers (except for Cotton and her husband’s brother-in-law, John Wheelwright) of preaching a “covenant of works.” Several ministers complained about Hutchinson to John Winthrop, who served several terms as governor of the colony, and eventually the situation erupted into what is known as the Antinomian Controversy, resulting in Hutchinson’s 1637 trial, conviction, and banishment from the colony.

She was quite the activist for her day and stood trial for heresy, literally standing throughout the proceedings while, in what was believed, to be an advanced stage of pregnancy. She faced two trials, civil and church, and was expelled from Massachusetts by Gov. John Winthrop after being convicted by the church on March 22, 1638.

After her conviction, Anne. along with her husband, children and some of her followers, with the encouragement of Roger Williams, established the colony of Portsmouth “in what would become the Colony of Rhode Island and Providence Plantations:”

During Hutchinson’s imprisonment, several of her supporters prepared to leave the colony and settle elsewhere. A group of her followers, including her husband Will, met on 7 March 1638, at the home of the wealthy Boston merchant William Coddington. Ultimately 23 men signed what is known as the Portsmouth Compact, forming themselves into a “Bodie Politick” and electing Coddington as their governor, but giving him the Biblical title of “judge.” Of the signers, 19 of them initially planned to move to New Jersey or Long Island, but Roger Williams convinced them to settle in the area of his Providence Plantations settlement. Coddington purchased Aquidneck Island, in the Narragansett Bay, from the Narragansetts and the settlement of Pocasset (soon renamed Portsmouth) was founded. Anne Hutchinson followed in April, after the conclusion of her church trial.

Hutchinson, her children, and others accompanying her traveled for more than six days by foot in the April snow to get from Boston to Roger Williams’ settlement at Providence. They then took boats to get to Aquidneck Island, where many men had gone ahead of them to begin constructing houses. In the second week of April, she reunited with her husband, from whom she had been separated for nearly six months. [..]

She lived there for a few years, but after her husband’s death, threats of Massachusetts taking over Rhode Island compelled her to move totally outside the reach of Boston, into the lands of the Dutch. Sometime in 1642 she settled with her younger children in New Netherland near an ancient landmark called Split Rock in what would later become Bronx, New York City. Here she had a home built, but tensions with the native Siwanoy were high, and following inhumane treatment by the Dutch, the natives went on a series of rampages known as Kieft’s War, and in August 1643, all but one of the 16 members of Hutchinson’s household were massacred during an attack. The lone survivor, nine-year old Susanna Hutchinson, was taken captive, and held for several years before being returned to family members in Boston.

Hutchinson is a key figure in the study of the development of religious freedom in England’s American colonies and the history of women in ministry. She challenged the authority of the ministers, exposing the subordination of women in the culture of colonial Massachusetts. Although her religious ideas remain controversial, her implicit rejection of state authority to prescribe specific religious rites and interpretations, was later enshrined in the American Constitution. Massachusetts honors her with a State House monument calling her a “courageous exponent of civil liberty and religious toleration.”

Beside being one of the few women who have a river named for them, Anne Hutchinson is thought to be the basis for the character of Hester Prynne in Nathaniel Hawthorne‘s The Scarlet Letter. The parallel being “that Hutchinson is the heretic who metaphorically seduces the Puritan community, while in Hawthorne’s novel Hester Pyrnne literally seduces the minister of her community.”

Considering the recent debate over women’s access to health care and our First Amendment rights, remembering the early history of religion and the role that women played is a reminder that this conversation has been going on for a lont time.

On this day in 1784, the Emerald Buddha is moved with great ceremony to its current place in Wat Phra Kaew, Thailand.

The Emerald Buddha is the palladium of the Kingdom of Thailand, a figurine of the sitting Buddha, made of green jadeite (rather than emerald), clothed in gold, and about 45 cm tall. It is kept in the Temple of the Emerald Buddha (Wat Phra Kaew) on the grounds of the Grand Palace in Bangkok.

According to the legend, the Emerald Buddha was created in India in 43 BC by Nagasena in the city of Pataliputra (today’s Patna). The legends state that after remaining in Pataliputra for three hundred years, it was taken to Sri Lanka to save it from a civil war. In 457, King Anuruth of Burma sent a mission to Ceylon to ask for Buddhist scriptures and the Emerald Buddha, in order to support Buddhism in his country. These requests were granted, but the ship lost its way in a storm during the return voyage and landed in Cambodia. When the Thais captured Angkor Wat in 1432 (following the ravage of the bubonic plague), the Emerald Buddha was taken to Ayutthaya, Kamphaeng Phet, Laos and finally Chiang Rai, where the ruler of the city hid it. Cambodian historians recorded capture of the Buddha statue in their famous Preah Ko Preah Keo legend. However, some art historians describe the Emerald Buddha as belonging to the Chiang Saen Style of the 15th Century AD, which would mean it is actually of Lannathai origin.

Historical sources indicate that the statue surfaced in northern Thailand in the Lannathai kingdom in 1434. One account of its discovery tells that lightning struck a pagoda in a temple in Chiang Rai, after which, something became visible beneath the stucco. The Buddha was dug out, and the people believed the figurine to be made of emerald, hence its name. King Sam Fang Kaen of Lannathai wanted it in his capital, Chiang Mai, but the elephant carrying it insisted, on three separate occasions, on going instead to Lampang. This was taken as a divine sign and the Emerald Buddha stayed in Lampang until 1468, when it was finally moved to Chiang Mai, where it was kept at Wat Chedi Luang.

The Emerald Buddha remained in Chiang Mai until 1552, when it was taken to Luang Prabang, then the capital of the Lao kingdom of Lan Xang. Some years earlier, the crown prince of Lan Xang, Setthathirath, had been invited to occupy the vacant throne of Lannathai. However, Prince Setthathirath also became king of Lan Xang when his father, Photisarath, died. He returned home, taking the revered Buddha figure with him. In 1564, King Setthathirath moved it to his new capital at Vientiane.

In 1779, the Thai General Chao Phraya Chakri put down an insurrection, captured Vientiane and returned the Emerald Buddha to Siam, taking it with him to Thonburi. After he became King Rama I of Thailand, he moved the Emerald Buddha with great ceremony to its current home in Wat Phra Kaew on March 22, 1784. It is now kept in the main building of the temple, the Ubosoth.

Spring Has Officially Sprung

Spring officially sprang at 1:14 AM Eastern Daylight Time on Tuesday. Partially because this is a “Leap Year”, in some times zones the Spring Equinox came as early as March 19 ending the winter that wasn’t for which many of us were relieved.

In case you did know the Spring Equinox is also called the “Vernal Equinox”, ver bring the Latin derivative for “spring.”  It occurs when the sun crosses the celestial equator and night and day are equal. It is really just a moment in time and if you blink, you missed it. In 45 BC, Julius Caesar set the date for the start of Spring on March 25th but sometime between the 4th and 16th centuries, the calendar drifted with respect to the equinox, such that the equinox began occurring on about March 21st.  

There are lots celebrations in many countries and cultures including the internet. Google celebrated with one of its popular animated “doodles.”

In Iran, ancient new year’s festival of Nowruz is celebrated:

According to the ancient Persian mythology Jamshid, the mythological king of Persia, ascended to the throne on this day and each year this is commemorated with festivities for two weeks. These festivities recall the story of creation and the ancient cosmology of Iranian and Persian people.

In many Arab countries, Mother’s Day is celebrated on the Spring equinox and the Jewish celebration of Passover starts on the first full moon after the Northern Hemisphere vernal equinox.

Most Christian churches calculate Easter as the first Sunday after the first full moon on or after the March equinox but the Eastern Orthodox Churches use the older Julian calendar so the actual date of Easter differs.

In Japan the Spring Equinox became an official holiday in 1948, Shunbun no hi.

We Pagans celebrate Ostara, one of the Eight Sabats of the Wheel, as a season of rebirth. The name is derived from Eostre, the Anglo-Saxon goddess of spring and fertility, and many symbols are associated with Ostara, including colored eggs and, what else? Rabbits:

In medieval societies in Europe, the March hare was viewed as a major fertility symbol — this is a species of rabbit that is nocturnal most of the year, but in March when mating season begins, there are bunnies everywhere all day long. The female of the species is superfecund and can conceive a second litter while still pregnant with a first. As if that wasn’t enough, the males tend to get frustrated when rebuffed by their mates, and bounce around erratically when discouraged.

Colored eggs are one of the symbols of fertility with an interesting, and this unconfirmed scary, history from Witches’ Voice :

(T)he traditional coloring and giving of eggs at Easter has very pagan associations. For eggs are clearly one of the most potent symbols of fertility, and spring is the season when animals begin to mate and flowers and trees pollinate and reproduce. In England and Northern Europe, eggs were often employed in folk magic when women wanted to be blessed with children. There is a great scene in the film The Wicker Man where a woman sits upon a tombstone in the cemetery, holding a child against her bared breasts with one hand, and holding up an egg in the other, rocking back and forth as she stares at the scandalized (and very uptight!) Sargent Howie. Many cultures have a strong tradition of egg coloring; among Greeks, eggs are traditionally dyed dark red and given as gifts.

As for the Easter egg hunt, a fun game for kids, I have heard at least one pagan teacher say that there is a rather scary history to this. As with many elements of our “ancient history, ” there is little or no factual documentation to back this up. But the story goes like this: Eggs were decorated and offered as gifts and to bring blessings of prosperity and abundance in the coming year; this was common in Old Europe. As Christianity rose and the ways of the “Old Religion” were shunned, people took to hiding the eggs and having children make a game out of finding them. This would take place with all the children of the village looking at the same time in everyone’s gardens and beneath fences and other spots.

It is said, however, that those people who sought to seek out heathens and heretics would bribe children with coins or threats, and once those children uncovered eggs on someone’s property, that person was then accused of practicing the old ways. I have never read any historical account of this, so I cannot offer a source for this story (though I assume the person who first told me found it somewhere); when I find one, I will let you know!

Oh, and that egg and, this year’s broom balancing thing, a myth that was debunked. Sorry.

Whatever you believe, or not, get out there in the garden or the park and celebrate the warmth of the sun, the longer days, renewal and rebirth.

Afghanistan: 11 Years, 5 Months and Counting

Never mind the riots, the fratricides, the burned holy books and the bloody slaughter of civilians. The commander of the Afghanistan war believes the decade-long conflict is “on track.”

That’s Gen. John Allen’s message to Congress at perhaps the most politically precarious moment in the decade-long war. Allen, in Washington for his first round of congressional testimony since taking command in July, told the House Armed Services Committee, “our troops know the difference they are making and the enemy feels it every day.”

Since Allen took charge of the war, the following has happened in Afghanistan: A U.S. special operations Chinook helicopter crashed, killing 27 troops, possibly after an insurgent attack. A different U.S. helicopter killed 24 Pakistani troops during a chaotic exchange of fire that lasted hours. Photos of Marines urinating on Afghan corpses emerged. U.S. troops burned the Koran at a giant wartime prison, prompting nationwide riots. In apparent retaliation, an Afghan employee of the Interior Ministry murdered two U.S. officers. A U.S. staff sergeant in Panjwei allegedly murdered 16 Afghan civilians, mostly women and children. The Taliban has suspended peace talks with the U.S. and Afghan President Hamid Karzai has proclaimed himself “at the end of the rope” with Washington.

“To be sure,” Allen testified, “the last couple months have been trying.”

March 21st is the common date of the March equinox (although astronomically the equinox is more likely to fall on March 20 in all but the most easterly longitudes). In astrology, the day of the equinox is the first full day of the sign of Aries. It is also the traditional first day of the astrological year.

On this day in 1804, the Napoleonic Code approved in France.

After four years of debate and planning, French Emperor Napoleon Bonaparte enacts a new legal framework for France, known as the “Napoleonic Code.” The civil code gave post-revolutionary France its first coherent set of laws concerning property, colonial affairs, the family, and individual rights.

In 1800, General Napoleon Bonaparte, as the new dictator of France, began the arduous task of revising France’s outdated and muddled legal system. He established a special commission, led by J.J. Cambaceres, which met more than 80 times to discuss the revolutionary legal revisions, and Napoleon presided over nearly half of these sessions. In March 1804, the Napoleonic Code was finally approved.

The Napoleonic Code, or Code Napoléon (originally, the Code civil des Français), is the French civil code, established under Napoléon I in 1804. The code forbade privileges based on birth, allowed freedom of religion, and specified that government jobs go to the most qualified. It was drafted rapidly by a commission of four eminent jurists and entered into force on March 21, 1804. The Napoleonic Code was not the first legal code to be established in a European country with a civil legal system, it was preceded by the Codex Maximilianeus bavaricus civilis (Bavaria, 1756), the Allgemeines Landrecht (Prussia, 1794) and the West Galician Code, (Galicia, then part of Austria, 1797). It was, however, the first modern legal code to be adopted with a pan-European scope and it strongly influenced the law of many of the countries formed during and after the Napoleonic Wars. The Code, with its stress on clearly written and accessible law, was a major step in replacing the previous patchwork of feudal laws. Historian Robert Holtman regards it as one of the few documents that have influenced the whole world.

Contents of the Code

The preliminary article of the Code established certain important provisions regarding the rule of law. Laws could be applied only if they had been duly promulgated, and only if they had been published officially (including provisions for publishing delays, given the means of communication available at the time); thus no secret laws were authorized. It prohibited ex post facto laws (i.e., laws that apply to events that occurred before them). The code also prohibited judges from refusing justice on grounds of insufficiency of the law-therefore encouraging them to interpret the law. On the other hand, it prohibited judges from passing general judgments of a legislative value (see above).

With regard to family, the Code established the supremacy of the husband with respect to the wife and children; this was the general legal situation in Europe at the time. It did, however, allow divorce on liberal basis compared to other European countries, including divorce by mutual consent.

Iraq Vet and Her Hero Dog to be Reunited

Some really great news, all be it, in the grand scheme of things not all that earth shaking but a win for an wounded Iraq veteran and her bomb sniffing dog, Sgt. Rex who will be reunited thanks to the efforts of New York Sen, Chuck Schumer and an animal loving blogosphere.

Wounded combat dog to rejoin Marine veteran

U.S. Sen. Charles Schumer said Monday night that the Air Force has agreed to release Sgt. Rex into the care of former Cpl. Megan Leavey, of Rockland County, just north of New York City.

Leavey was injured with Rex in 2006 while trying to disarm an explosive. They convalesced together.

Rex is credited with saving lives and uncovering explosives that saved more.

Schumer had intervened when Leavey, a Purple Heart recipient, was first denied in her effort to adopt Rex in 2007. Rex had recovered with Leavey from their injuries, and Rex was returned to service.

Now Rex, a black and brown German Shepherd, is 10 years old and can’t continue his military service, but Schumer said bureaucracy still stood in the way of the adoption.

“We salute the Air Force and the Marines for doing the right thing and allowing Rex to be with Corporal Leavey,” Schumer said Monday night. “One canine, one human, both heroes. They should be united shortly, and we’re glad it’s happening.” [..]

Schumer, a Democrat, had sought to help Leavey cut through red tape to reunite the pair. He also started a national online petition to help persuade the Air Force to act quicker.

“It’s only appropriate and right that the two of them enjoy their retirement from the service together,” Schumer said. “I again want to thank the Air Force and Marines for moving so quickly, and I want to thank the thousands of New Yorkers and Americans who showed their support online.”

Leavey recently told MSNBC that Rex is her partner and she loves him.

“We have been through so much together,” she said. “… I’ve spent day and night with this dog. It’s a very strong bond.”

It’s Still the Economy, Stupid

One of the reasons that the Republicans lost so badly in 2006 and 2008 and the reason the Democrats took such a dive in 2010 was the economy. Since then the job approval rating of Congress has plummeted with the Republicans fairing worse than the Democrats but only slightly. In regards to the economy the public in general doesn’t think that President Obama is doing such a great job, either. People are worried about jobs, good jobs not deficits. Deficit and the national debt are not what is holding back the economy, it’s jobs.

The Republicans in the House seem to be intent on killing more jobs with its latest suicide pact that would cut everything from taxes for the wealthy, food stamps, destroy Medicare, and spending cuts. As Roger Hicky in his Huffington Post article point out, the Republican budget clearly rejecting what the American public wants.

The only thing that could save Republicans would be if Democrats, like Oregon Senator Ron Widen or House Democratic Whip Steny Hoyer, persuaded their party to ignore American public opinion and join with the GOP in destroying Medicare, cutting Social Security, and slashing public spending in a way that cripples the economy and rewards the wealthy. That’s what the Ryan Republican budget would do, and Democrats — and Americans who believe in majority rule — need to explain the extreme nature of this budget to the American people. [..]

So, the brand-new Ryan Republican budget, so very like last year’s Ryan budget, is already unpopular with the American majority, in all of its major elements. Progressives and Democrats should immediately publicize its many unpopular pieces so the public knows about them all. We should immediately demand to know whether the Republican candidates for president embrace it. And we should keep a wary eye out for Democrats who are willing to give the Republicans cover. When the Paul Ryan Republicans — enemies of everything the American majority believe in — are putting a gun to their heads and are about to pull the trigger, progressives should get out of the way and publicize the results — from now until the November elections.

It is obvious from the results of these kinds of cuts in Europe, austerity budgets don’t work. The Occupy Wall Street movement changed that conversation six months ago.

If Obama and the Democrats are smart, they’ll listen to the American public, sit back and let the Republicans pull the trigger.

Up Date: Ezra Klein, writing in the Washington Post, sums up Ryan’s latest version of a “budget plan” in one sentence:

Ryan’s budget funds trillions of dollars in tax cuts, defense spending and deficit reduction by cutting deeply into health-care programs and income supports for the poor.

The last I checked that isn’t going to win them any elections but you never know when the Democrats will ride into save the day. Calling Ron Wyden.

Foreclosure Fraud: More Reasons to Hate It

The more the experts and analysts look into the Foreclosure Agreement the more reasons are found to hate it and why, to Yves Smith‘s descriptive word, it “sucks”:

Not only are the banks getting away with fraud they are still going to be allowed to systemically overcharge homeowners and wrongly take their homes.

Remember that the Administration also trumpeted that enforcement would be tough, even as Abigail Field has shown that idea to be a joke. For instance, the servicing standards allow for the astonishing concept of an acceptable error rate. Banks aren’t permitted to make errors with your checking account and ding you an accidental $10,000 and get away with it. But with people’s most important asset, their homes, servicers are allowed a certain level of reportable errors, and many of them can be serious as far as borrowers are concerned.[..]

She also points out that wrongful foreclosures at a 1% rate are acceptable. Procedures around real estate are deliberate because any error of this magnitude has devastating consequences. But this new provision means that 1%, or over 33,000 erroneous foreclosures since 2008 would be perfectly OK as far as the authorities are concerned.

Field also points out in a separate post that this deal is in no way done. Key points remain to be resolved, in particular, how the Monitor will supervise the pact. That’s a huge item, and leaving it unresolved shifts the power to the banks (if you don’t believe me, I refer you to what is happening to Dodd Frank).

Field also wonders “how did all our meaningful law enforcers do this deal?:

I hate the term Too Big To Fail because it’s a loaded premise presented as fact. But looking at the weasel parentheticals, maybe we should start asking if the banks as too big to be competent. I mean, why do the banks need a ‘hey, we tried but didn’t have enough time to stop the sale’ exemption? If the B.O.Bs (bailed out bankers) want their lawyer or trustee to call off a foreclosure sale, all they need is two things: a) to contact their agent and b) have a competent agent.

What does “took appropriate steps to stop the sale” mean, anyway? Does it mean that someone at the bank left a message or two with foreclosure counsel? If the B.O.B.s made a real effort to stop the sale but their agents did it anyway, why isn’t that the B.O.B’s fault for having incompetent agents? Doesn’t giving the B.O.B. a pass remove any incentive to have competent (and thus more expensive) agents?

Wrongfully selling someone’s home should be a strict liability issue. Strict liability is, well, strict: no one cares what you were trying to do, what your intentions were, what you did or didn’t do. Did the harm happen? Then you’re responsible.

Before you give me any, hey, let’s be reasonable here, a business needs to operate and we’re so big some mistakes will happen, remember what we are talking about: homes; property rights; land records; fundamental fairness. How can the B.O.Bs be held to any standard other than strict liability when it comes to wrongfully selling a home?

Neil Barofsky, the former Special US Treasury Department Inspector General for the Troubled Asset Relief Program (TARP) and Matthew Stoller, a fellow at the Roosevelt Institute give a good overview of why this settlement really “sucks”

There is no accountability, no punishment for what has to be the largest fraud ever perpetrated in this country.

March 20th is also the usual date of the vernal equinox in the Northern Hemisphere, and the autumnal equinox in the Southern Hemisphere when both day and night are of equal length, therefore it is frequently the date of traditional Iranian holiday Norouz in many countries.

On this day in 1854, Republican Party is founded in Ripon Wisconsin.

The Republican Party emerged in 1854, growing out of a coalition of former Whigs and Free Soil Democrats who mobilized in opposition to the possibility of slavery extending into the new western territories. The new party put forward a vision of modernizing the United States-emphasizing free homesteads to farmers (“free soil”), banking, railroads, and industry. They vigorously argued that free-market labor was superior to slavery and the very foundation of civic virtue and true republicanism, this is the “Free Soil, Free Labor, Free Men” ideology. The Republicans absorbed the previous traditions of its members, most of whom had been Whigs; others had been Democrats or members of third parties (especially the Free Soil Party and the American Party or Know Nothings). Many Democrats who joined up were rewarded with governorships. or seats in the U.S. Senate or House of Representatives. Since its inception, its chief opposition has been the Democratic Party, but the amount of flow back and forth of prominent politicians between the two parties was quite high from 1854 to 1896.

Two small cities of the Yankee diaspora, Ripon, Wisconsin and Jackson, Michigan, claim to be the birthplace of the Republican Party (in other words, meetings held there were some of the first 1854 anti-Nebraska assemblies to call themselves by the name “Republican”). Ripon held the first county convention on March 20, 1854. Jackson held the first statewide convention on July 6, 1854; it declared their new party opposed to the expansion of slavery into new territories and selected a state-wide slate of candidates. The Midwest took the lead in forming state party tickets, while the eastern states lagged a year or so. There were no efforts to organize the party in the South, apart from a few areas adjacent to free states. The party initially had its base in the Northeast and Midwest. The party launched its first national convention in Pittsburgh, Pennsylvania, in February 1856, with its first national nominating convention held in the summer in Philadelphia, Pennsylvania.

John C. Fremont ran as the first Republican nominee for President in 1856, using the political slogan: “Free soil, free labor, free speech, free men, Fremont.” Although Fremont’s bid was unsuccessful, the party showed a strong base. It dominated in New England, New York and the northern Midwest, and had a strong presence in the rest of the North. It had almost no support in the South, where it was roundly denounced in 1856-60 as a divisive force that threatened civil war.

Historians have explored the ethnocultural foundations of the party, along the line that ethnic and religious groups set the moral standards for their members, who then carried those standards into politics. The churches also provided social networks that politicians used to sign up voters. The pietistic churches emphasized the duty of the Christian to purge sin from society. Sin took many forms-alcoholism, polygamy and slavery became special targets for the Republicans. The Yankees, who dominated New England, much of upstate New York, and much of the upper Midwest were the strongest supporters of the new party. This was especially true for the pietistic Congregationalists and Presbyterians among them and (during the war), the Methodists, along with Scandinavian Lutherans. The Quakers were a small tight-knit group that was heavily Republican. The liturgical churches (Roman Catholic, Episcopal, German Lutheran), by contrast, largely rejected the moralism of the Republican Party; most of their adherents voted Democratic.
