This series is following the syllabus for the class called The First Amendment and taught at Yale Law School by Professor Jack M. Balkin. As with the Friday Constitutional series this is a layman’s look at the Law, specifically the Supreme Court opinions which have shaped the boundaries of our 1st Amendment Protections. There has been a lot of talk about the demise of the Republican Party. The Dog has, himself, been part of this talk. Whenever this topic comes up there are those that point out the various times where the Republican Party or even the Democratic Party were down and looked as though they might be out, then have come back in with surprising swiftness. These arguments are true as far as they go but one of the major failings the Dog always finds with these comparisons is they only look at the results and fail to take into account the circumstances which allowed these changes of fortunes for the Party.

Welcome to the 12th in the Dog’s letter writing campaign series. This basic idea of this series is to write to decision and opinion makers every week to push for accountability on for the Bush era State Sponsored Torture program. The Dog writes the letters and provides the links for each week, you provide the action by either cutting and pasting the letter or by using its topic to write your own letter. This is a low level type of action but it is by being relentless and consistent that we keep the pressure on those who can either start investigations or take actions which will make the need for action clearer.

Lets start with the meat of this essay, there is no meat. If you came by looking for issues or action or insight (not that you get a lot of the last from the Dog anyway) you are SOL, that’s right you are a Slovenian On Leave. However if you are looking for a place to be a little silly, to let your hair down and get to know a little something about your fellow community members, well you are in the right place!  

Disclaimer: If you are not doing what the Dog is talking about in this essay, then it is not directed at you! So, please don’t take offense where the Dog did not offer it.

This has been said by the Admins but the Dog is going to make his own plea about this. For the love the Flying Spaghetti Monster could we just not rehash all the shit from Daily Kos?

The Dog knows there are a bunch of folks who were banned there or left because of banning or policies or because they did not like the tone. The thing is by bringing this up constantly you are not actually making this site any better.  

There is more to life than just politics. Every once in a while you have to do something different and new. Below is my attempt at this. When I write under the name of Something The Dog Said, I am pretty comfortable that I can do it well, both from a knowledge and style perspective. I am not as convinced that I can do as well in the realm of fiction, but I have decided to find out.

This is the first installment in a novel I have written. I am taking the risk of posting it here as I need some feed back. I trust the DD crowd to tell me the truth. If it is unreadable, let me know, if it is average, well I want to hear that too. Any input anyone would like to provide I will take to heart, up to and including hearing “I could eat a piece of paper and typewriter ribbon and crap a better novel than that, don’t embarrass us or yourself any further by posting the rest”, say what you think.

This is a fantasy novel set in a slightly alternate Europe in the early 1000’s. Without further build up:

This week we don’t actually have a Supreme Court case, as the High Court refused to take up the appeal on this one. It is still part of Professor Balkin’s syllabus and as we look at the details you will see why it is an important First Amendment case. Last week the President made a speech about the closing of Guantanamo Bay Prison. Most of us politically savvy (obsessed?) folks have heard it and heard some of the various analysis of it. One area of concern was the President’s contention that, due to factors which happened in the previous administration, he might not be able to try all of the accused prisoners in Federal Courts as he had previously promised. He went further to saying he thought that a revamped Military Commissions structure could be used to do the job, and thus avoid trying these men in Federal Court.
