In the early 1940s, a politically ambitious butcher from West Virginia named Bob Byrd recruited 150 of his friends and associates to form a chapter of the Ku Klux Klan. After Byrd had collected the $10 joining fee and $3 charge for a robe and hood from every applicant, the “Grand Dragon” for the mid-Atlantic states came down to tiny Crab Orchard, W.Va., to officially organize the chapter.

As Byrd recalls now, the Klan official, Joel L. Baskin of Arlington, Va., was so impressed with the young Byrd’s organizational skills that he urged him to go into politics. “The country needs young men like you in the leadership of the nation,” Baskin said.

According to his book, Byrd wrote to Samuel Green, an Atlanta doctor and “Imperial Wizard” of the Ku Klux Klan, in late 1941 or early 1942, expressing interest in joining. Some time later, he received the letter from Baskin, the “Grand Dragon” of mid-Atlantic states, saying he would come to Byrd’s home in Crab Orchard whenever Byrd had rounded up 150 recruits for the Klan.

When Baskin finally arrived, the group gathered at the home of C.M. “Clyde” Goodwin, a former local law enforcement official. When it came time to choose the “Exalted Cyclops,” the top officer in the local Klan unit, Byrd won unanimously.

That puts him at about MY age (early 20’s) at the time he made this decision.  Uh, sorry, no.  You were well aware of what you believed and it’s fair to hold it as a reflection on your character.

It’s ok though:

Byrd said last week that his membership in the Baptist church tempered his views and marked “the beginning of big changes in me.” And like other southern and border-state Democrats of his time, Byrd came to realize that he would have to temper his blatantly segregationist views and edge toward his party’s mainstream if he wanted to advance on the national stage.

Official Title of Legislation:

S Amdt 4177 to S 2611: To provide a substitute to title III.

Highlights:

– Makes it illegal to hire undocumented immigrants (Sec. 301: now Sec. 274A (a)(1))

– Calls for an Electronic Employment Verification System to be implemented that checks that identity information input into the system matches the information that the Commissioner of Social Security has and that identifies an individual as eligible or ineligible for employment in the U.S. (Sec. 301 now Sec 274 A (d)(1))

– Mandates that employers use the Electronic Employment Verification System to verify employment status of all employees 18 months after $400 million has been appropriated to implement the system (Sec. 301 now Sec 274A (d)(2))

– Requires employers to submit an employer identification number for each employee to the Electronic Verification System (Sec 301 now Sec 274A (a)(3)(C))

– Sets the penalty of a fine not more than $5,000, prison for no more than 3 years or both for an employee who falsely says he or she is eligible for employment in the U.S. (Sec. 301 now Sec 274A (c)(2)(B))

– Requires that employers certify that they have examined a US passport, driver’s license or identity card issued by a state or Commonwealth of the U.S, a permanent resident card, an employment authorization card, or a document with a photograph of the individual or their name, date of birth, gender and address for each employee (Sec. 301 now Sec 274A (c) (1))

– Protects any employer that relies on the Electronic Employment Verification System in good faith from liability for an employment related action (Sec. 301 now Sec 274A (d)(1))

– Requires employers to fire any employee that the system confirms is not eligible to work in the U.S (Sec. 301 now Sec 274A (d) (8) (D) (x))

– Allows any potential employee that receives notification of their ineligibility to work in the U.S to request an administrative and then a judicial review of their status (Sec. 301 now Sec 274A (d) (10) (A))

– Authorizes the payment of lost wages to any individual that was wrongfully categorized as ineligible to work in the U.S (Sec. 301 now Sec 274A (d) (11) (D) (i))

– Sets the penalty of at $500 to $4,000 for each illegal immigrant that an employer continues to employee after verification that they are ineligible to work in the U.S and increases the fine for each subsequent violation within a 24 month period (Sec. 301 now Sec 274A (e)(4)(A))

– Provides criminal penalties of at most $20,000 for each undocumented immigrant, imprisonment for not more than 3 years or both for an employers with a pattern or practice of violating employment, recruitment, or referral requirements (Sec. 301 now Sec 274A (f))

– Allows employers who are adversely affected by a final determination to request a judicial review of the decision (Sec 301 now Sec 274A (e)(5))

– Bans employers who violate the employment requirements repeatedly from receiving or maintaining government contracts for 5 years (Sec 301 now Sec 274A (i))

National Guard at the border not enough:


While I still have questions about how the National Guard will carry out the missions that are assigned to it, we must not overlook the fact that the Administration has missed many opportunities to tighten controls at our borders without depending on our citizen-soldiers to do the job. Since September 11, I have offered nine amendments to provide more funds to hire more Border Patrol agents, strengthen security at our borders, and stop the flow of illegal immigrants and contraband into our country. The Administration opposed each one of my amendments, labeling them to be “extraneous,” “unnecessary” spending that would “expand the size of government.” If my amendments had been approved and supported by the Administration, there would be thousands more Border Patrol agents on the job today.

The “Exalted Cyclops” seemed to miss the memo on legalization of Marijuana to end the security threat “contraband” posed and still seems to think only those on the fucking Mayflower can be Americans.

Nothing pisses me off more then assholes that use “illegal immigrants” as one of those things to get some of the Republican constituency to give him a pass.  Using immigrants as a political football, at least he ain’t lynchin’em I guess.

Hmmm, let’s see where he stands on crime and punishment shall we?

95% of Death Row inmates are represented by a Public Defender so we can bet they ain’t exactly millionaires.  54% of those sentenced to death are Black or Hispanic, compare that in proportion to their total population in America and we can see the scale is tipped to be heavier on minorities then Whites.

Vote to adopt an amendment that substitutes life imprisonment with no possibility of release for all death penalty provisions.

  1. I really have respect for Byrd, he led 32 other senators in voting against the Iraq war and was a very vociferous opponent of our being involved in Iraq. I have to give him props for that.

    You do good digging, and I give you props for that too, but I am willing to believe the big racism stick got taken out of the Exalted Cyclops’ eye a few decades ago. People learn, and change, and can outgrow these stupid beliefs and I am willing to grant that he managed to do that.

    As for his vote on this issue, however, THAT definitely sucks. Wow.

    Thanks for this series. We need eyeballs on this problem.
