Systemic Rot

President Obama signed the National Defense Authorization Act (NDAA) today despite his veto threat. The law now restricts detainee transfers out of military prisons in Afghanistan and Guantánamo Bay. “Obama attached a signing statement claiming that he has the constitutional power to override the limits in the law,” the New York Times reports. “Despite his objections, Mr. Obama signed the bill, saying its other provisions on military programs were too important to jeopardize.”

Obama’s three page signing statement objected to many parts of the bill. For example, Obama objects to what I’m calling the “Romney battleship preservation” clause:

In a time when all public servants recognize the need to eliminate wasteful or duplicative spending, various sections in the Act limit the Defense Department’s ability to direct scarce resources towards the highest priorities for our national security. For example, restrictions on the Defense Department’s ability to retire unneeded ships and aircraft will divert scarce resources needed for readiness and result in future unfunded liabilities.

But, more troublesome to the president and those of us who want to see Gitmo closed, is the NDAA interferes with his ability to close military detention prisons. He writes:

Several provisions in the bill also raise constitutional concerns. Section 1025 places limits on the military’s authority to transfer third country nationals currently held at the detention facility in Parwan, Afghanistan… Decisions regarding the disposition of detainees captured on foreign battlefields have traditionally been based upon the judgment of experienced military commanders and national security professionals without unwarranted interference by Members of Congress. Section 1025 threatens to upend that tradition, and could interfere with my ability as Commander in Chief…

Section 1028 fundamentally maintains the unwarranted restrictions on the executive branch’s authority to transfer detainees to a foreign country. This provision hinders the Executive’s ability to carry out its military, national security, and foreign relations activities and would, under certain circumstances, violate constitutional separation of powers principles… The Congress designed these sections, and has here renewed them once more, in order to foreclose my ability to shut down the Guantanamo Bay detention facility.

There has been much criticism of the 112th Congress as the worst Congress ever, but writing at Esquire today, Charlie Pierce observes that it is more than just Congress that is out-of-whack when it comes to governance. Presidential signing statements are another alarm warning us that our system of government is broken. Pierce writes:

Yes, Congress has partly tied his hands, and it has done so by making it harder for him to close Gitmo down. But, even against that, the president argues for the supremacy of the executive branch in such matters. That, coupled with a veto warning that was as empty as a toddler’s threat to run away from home, vitiates any case the president might choose to make that what he really wants to do is to protect the Bill Of Rights. The presidency has been allowed to become a dangerous beast over a number of decades, to the point where anyone who seeks it can rightly be presumed to have at least the spark of lawless authoritarianism in him. And, if that spark is there, the presidency will seek it out and bring it to flame. This president is no different.

Despite the conservatives’ deranged bluster, Obama is not acting differently from any other chief executive we’ve had since the end of World War II according to Pierce. For example, the Obama administration has refused to disclose which criteria are used to kill people with drone missile attacks. The legality of the strike that killed American-born Anwar al-Awlaki in Yemen is debatable.

Yesterday, a Freedom of Information Act lawsuit filed by ACLU and the New York Times was rejected by the U.S. District Court for the Southern District of New York. “Judge Colleen McMahon found that though she agrees that debate on the usage of drone strikes should be made in the open, she is unable to force the government to turn over the documents under FOIA”.

In her ruling, McMahon wrote:

However, this Court is constrained by law, and under the law, I can only conclude that the Government has not violated FOIA by refusing to turn over the documents sought in the FOIA requests, and so cannot be compelled by this court of law to explain in detail the reasons why its actions do not violate the Constitution and the laws of the United States. The Alice-in-Wonderland [sic] nature of this pronouncement is not lost on me; but after careful and extensive consideration, I find myself stuck in a paradoxical situation in which I cannot solve a problem because of contradictory constraints and rules – a veritable Catch-22. I can find no way around the thicket of laws and precedents that effectively allow the Executive Branch of our Government to proclaim as perfectly lawful certain actions that seem on their face incompatible with our Constitution and laws, while keeping the reason for their conclusion a secret.

From this Pierce concludes:

This is the way all presidents, most especially including this one, want it to be. This is the way the presidency has insisted on operating ever since the Cold War. This is what you get when you don’t listen to old Ike’s warning, when you let the Kennedys run amuck concerning Castro, when you let Lyndon fake an incident in the Tonkin Gulf, when you impeach Nixon over a burglary and not the illegal bombing of Cambodia, when you let everyone skate on Iran-Contra, when you impeach one president over a blowjob but let another one slide for lying the country into a war, for abrogating treaties and violating international law regarding torture, when you let a sociopath like Richard Cheney anywhere near the levers of power, and when you let a president decide which American lives or dies by standards he declines to share with the rest of us. This is what you get. Barack Obama didn’t sell out the Bill Of Rights today because he’s Barack Obama. Barack Obama sold out the Bill Of Rights today because he’s the president of the United States, and that’s now part of the damn job description.

If the job description for the President of the United States is to sell out the Bill of Rights, then America has more problems than just the worst Congress ever. The separation of powers, our whole system of checks and balances, are rotting away. This is the core of our Constitution.

While many of us on the left trust President Obama to do the right thing. The problem is that Obama will only be at the White House for four more years. Instead of having laws to protect us the abuse of power, we are left with having personalities to protect us from the abuse of power. What happens with the next president? Will he or she ignite that “spark”?

Presidents have proved to be unwilling to relinquish any power secured by their predecessors. For example, in 2008, soon-to-be former Vice President Cheney predicted then President-elect Obama would “appreciate” the expansion of presidential power that happened in the Bush administration. Cheney said:

Once they get here and they’re faced with the same problems we deal with every day, then they will appreciate some of the things we’ve put in place…

I believe very deeply, in a strong executive, and I think that’s essential in this day and age. And I think the Obama administration is not likely to cede that authority back to the Congress. I think they’ll find that given a challenge they face, they’ll need all the authority they can muster.

In turn, then-President-elect Obama said four years ago that he was reluctant to investigate Bush-era abuses of power, citing his “belief that we need to look forward as opposed to looking backwards.”

The inability of neither our partisan Congress nor our self-interested executive branch nor our law-twisted courts to investigate or limit or hold accountable the expansion of presidential power demonstrates a systemic flaw on our republic. This growing inability to hold accountable those serving in our nation’s highest offices allows for more potential abuses of power.

When presidents believe it is necessary to sign bills with caveats, because a veto means throwing needed legislation back to a dysfunctional lawmaking body; when the presidency collects more power and all that is needed for the person in the Oval Office to get a “spark” of authoritarianism to burst into flame; when our federal judges cannot find themselves in a “Catch-22” situation making it impossible to hold the executive branch accountable nor require them to explain their secrecy, then we have more problems than just the worst Congress ever. We’re getting closer to the worst government ever.

The nation’s constitutional core is rotting away.

The Next Mythical Cliff: The Debt Ceiling

The sequel to the the Bush/Obama tax debacle  is the unconstitutional debt ceiling. According to the 14th Amendment, the US has to pay its bills, even if the government has to borrow the money through bond sales. So the debt ceiling is another manufactured “cliff” that was created to curb spending which it didn’t, obviously, or we wounded be having another media side show staring the White House and the Congressional leadership. McConnell: Spending fight coming whether Obama ‘wants it or not’

Senate Minority Leader Mitch McConnell (R-KY):

President Obama will get a fight over government spending with a hike to the debt limit “whether he wants it or not,” Senate Minority Leader Mitch McConnell (R-Ky.) wrote Thursday.

In an op-ed for Yahoo, McConnell wrote that Republicans would focus on reducing spending in the next Congress, and in conjunction with the debate over raising the $16.4 trillion debt ceiling. Congress will likely need to take action on the debt limit within the next two months.

“The president may not want to have a fight about government spending over the next few months, but it’s the fight he is going to have, because it’s a debate the country needs,” McConnell warned.

Last night the House of Representatives voted to make permanent the Bush/Obama tax cuts on all but the top 1% of tax payers and increasing taxes on on 77.1 percent of U.S. households, mostly because of the expiration of a payroll tax cut. With the bill set to be signed by Pres. Barack Obama, Congress and the White House move to the next manufactured crisis that this bill set up, the draconian sequester cuts to defense and non-defense spending and the debt ceiling, also a manufactured “crisis.” The bill did hold off those draconian cuts for two months, just in time for spending to hit the debt ceiling.

Pres. Obama made it clear in his address after the passage of the “Fiscal Cliff” bill, that he would not allow the debt ceiling to be used as a bargaining chip in negotiations over spending.

“I will not have another debate with this Congress over whether or not they should pay the bills that they’ve already racked up through the laws that they passed. We can’t not pay bills that we’ve already incurred.”

“If Congress refuses to give the United States government the ability to pay these bills on time, the consequences for the entire global economy would be catastrophic – far worse than the impact of a fiscal cliff.”

This bill was not the best deal as this article on the behind the scenes Senate dealings by Ryan Grym at Huffington Post tells it:

The White House sent Reid a list of suggested concessions as his staff debated what to send back to McConnell. Reid looked over the concessions the administration wanted to offer, crumpled up the paper and tossed it into his fireplace. The gesture was first reported by Politico and confirmed to HuffPost by sources with knowledge of it, who noted that Reid frequently keeps his fire going and is fond of feeding a variety of proposals to it.

Reid’s staff then called McConnell’s office with a simple message: Our last offer stands. There will be no further concessions. McConnell took to the Senate floor, complaining that he had no “dance partner” in Reid, and called Vice President Joe Biden, a man he assumed would be more willing to give. McConnell was right.

Perhaps the most important concession he wrangled from the administration, which Reid had been unwilling to make, was a two-month extension of the sequester, automatic cuts to defense spending and domestic programs that were supposed to be triggered Jan. 1. Reid wanted much more, worried that the two-month period will simply set up another colossal showdown that will also rope in the debt ceiling and funding for the government. “The deal itself is OK, but sets up Democrats for [a] worse fight and strengthens Republicans’ hand for what they really want: cuts,” said a Democratic source close to Reid. “Biden gave away the store on timeline. Two months and we’re back at this and in worse shape.”

President Barack Obama has vowed not to negotiate over the debt ceiling, but Democrats in the Senate are worried that they’ve now lost their leverage. “Everyone knew taxes would be raised on high earners,” said the Democratic source. “So with that out of the way, what do we bargain with?”

All they had to do was let the tax cuts end and pass new tax bill that included extension of unemployment benefits, ended unconstitutional the debt ceiling nonsense and added some stimulus to really create jobs, since we all know that tax cuts don’t. But no, Pres. Obama had to have this done and kept backing away from his so-called “line in the sand.”

If anyone believes at this point that Obama stand up to the threats of a government shut down by Republicans refusing to raise the debt ceiling without serious concessions on Medicare and Social Security, consider these three reasons to doubt from Jon Walker at FDL Action

1) Failure to stick to previous lines in the sand – In past negotiations Obama has failed to stick to his previous lines in the sand. Obama did not stick to his demand that the Bush tax cuts end for income over $250,000. Similarly despite saying he would not play games with the debt ceiling, Obama seemed to treat it as just another bargain chip when trying to get a deal with John Boehner.

2) Dismissing unilateral action – The Obama administration has dismissed unilateral action to address the debt ceiling. Doing something like invoking the 14th amendment would probably be the easiest way to defuse the fight, but the administration has declared that “not an option.” Even if the Obama team didn’t think it was a legally viable solution by completely removing the threat it has weakened its bargaining position.

3) Allowing the creation of a new super cliff in two months – When WP Joe Biden took over the negotiations from Sen. Harry Reid the major concession he made was to have only a two month delay of the sequestration cuts instead of a one year delay.

Meanwhile the “irrational exuberance” of Wall St’s feral children over the tax deal abounds with the markets closing on a high. Let’s see what happens in two months when we sit on the edge of another cliff.

Congressional Game of Chicken: On the Brink of a Stalemate

Up Date 16:33 EDT: Republican Senators have taken Social Security off the table as part of the negotiations for the “fiscal cliff.”

With the deadline for the expiration of Bush Tax cuts and austere spending cuts, the Senate negotiations have reached a stalemate. At the last minute, the Republicans demanded significant cuts to Social Security benefits. House Majority Leader Harry Reid (D-NV), who was described as  “shocked and disappointed” and this may well be the “poison pill” that ends the charade of “fiscal cliff” talks.

The development came after a long weekend of negotiations during which the two sides had been making progress.

The aide said Democrats had shown flexibility on the major sticking points involving taxes. They had not ruled out maintaining the tax on inherited estates at the current low rate, as Republicans prefer. And they had been open to a deal that would allow taxes to rise on many fewer wealthy households than President Obama had proposed. Republicans were seeking tax increases only on income higher than $400,000 or $500,000 a year, while Obama wanted to set the threshold at $250,000 a year.

But Obama was pressing for $30 billion in new spending to keep unemployment benefits flowing to the long-term unemployed, and he wanted to postpone roughly $100 billion in automatic spending cuts set to hit agency budgets next months. In exchange for those items, Senate Minority Leader Mitch McConnell (R-Ky.) insisted Sunday that Democrats put cuts to Social Security benefits on the table, noting that Obama had offered to do so as part of the big deficit-reduction package he had been negotiating with House Speaker John A. Boehner (R-Ohio.)

Republicans declined to comment on the new offer, but noted that Obama endorsed the adjustment, known as chained CPI, again Sunday, in an interview on NBC’s Meet the Press.

President Obama suggested that he was open to the highly unpopular proposal to cut increases to Social Security by linking it to the “chained CPI” in the context of a larger deal.

The other “monkey wrench” that McConnell threw into the mix was estate taxes which are scheduled to increase to the Clinton level of 55% on estates over one million dollars. The estate tax currently exempts the first $5 million of inheritance and taxes the remainder at 35 percent, which the Republicans want to keep. Pres. Obama wants to make it less generous, reducing the exemption to $3.5 million and taxing the remainder at a 45 percent rate. This tax only affects an extremely small number of people.

Under the Republican proposal, 3,800 people would pay the estate tax year, also near an average of $3.3 million. The GOP proposal would raise $182 billion for federal tax coffers over the next 10 years.

Under Obama’s proposal, 6,500 people would pay the estate tax next year, with an average payment estimated at about $3 million. The president’s proposal would raise $284 billion in tax revenue over the next 10 years.

No action by Congress would send the estate tax back to what it was in the 1990s – with a $1 million exemption and 55 rate percent for the remaining share. That would affect more than 40 million Americans.

Senate Minority Leader Mitch McConnell (R-SC) has reached out to Vice President Joe Biden to break the impasse.

 

The Great Prevaricator

Barack Obama’s presidential legacy will most likely be that he was the Great Prevaricator. His plan has always been to protect the 1% and sell out the rest of us. So far he succeeded quite nicely, with just a few minor bumps in the road that were possibly preplanned.

Two important points that Jane Hamsher and Jon Walker at FDL Action makes about Barack Obama, that even Marcos Moulitsas gets wrong, is:

1st, Ms. Hamshire writes that Pres. Obama did not capitulate on Social Security cuts and we should stop pretending that he did:

Everywhere you look, the media narrative is that President Obama is “capitulating” to Republicans by agreeing to cuts in Social Security benefits.

And I have to ask, where is this collective political amnesia coming from?

Obama has made a deliberate and concerted effort to cut Social Security benefits since the time he took office.  FDL reported on February 12, 2009 that the White House was meeting behind closed doors to consider ways to cut Social Security benefits, and that the framework they were using was the Diamond-Orszag plan, which was co-authored by OMB Director Peter Orszag when he was at the Brookings Institute.

The birth of the now-ubiquitous “catfood” meme came on February 18, 2009 with this FDL headline:

The administration backed off its immediate plans for reforming Social Security. The New York Times reported that they were “running into opposition from his party’s left” who are “vehement in opposing any reductions in scheduled benefits for future retirees.” But NYT columnist David Brooks reported that shortly after the summit, “four senior members of the administration” called him to say that Obama “is extremely committed to entitlement reform and is plotting politically feasible ways to reduce Social Security.” [..]

In January of 2010, a bill sponsored by committed Social Security slashers Judd Gregg and Kent Conrad which would have created an official commission to make recommendations about the nation’s deficit was defeated by the Senate on a bipartisan vote – 22 Democrats and 24 Republicans voted no.

After the Senate defeat, on February 18, President Obama issued an executive order creating what subsequently became known as the “Catfood Commission” anyway. [..]

The composition of the Commission was conveniently stacked with 14 of the 18 members committed deficit hawks looking to start balancing the federal budget on the backs of old people.

And who supplied the staff to the commission? Why, Pete Peterson.

Are we to believe that the President was blissfully ignorant of the agendas of the people he appointed to this commission, created with the goal of bypassing Congressional process? [..]

The President has been very forthcoming about the fact that cutting Social Security benefits is something he wants to do.  When he said during the debate that he didn’t differ from Mitt Romney on entitlement reform, he meant it.   It’s time for people to remove the rose-colored glasses and stop projecting their own feelings on to the man.  It’s time to take him at his word.

This is what he has always wanted. Ignore it if you choose but the facts and Obama’s actions and words bear it out.

2nd, John Walker points out that Pres. Obama lied about not raising taxes on the middle class. By using the chained CPI, a lower measure of inflation, no only are SS benefits cut, it winds up being it would end up being a significant tax increase on the middle class by causing tax brackets to raise more slowly. While the tax increase would be very small at first, over the next decade it would mean the middle class will pay ten of billions more in taxes. John calls this the “Lie of the Year

For five years Obama repeatedly and unequivocal promised not the raise taxes by one penny on anyone making less than $250,000. He did so in ads, campaign stops, emails, and interviews. There is probably no other single policy proposal that was more central to both of Obama’s presidential campaigns. Millions likely voted for Obama based on this firm promise.

Yet even before Obama’s second term begins, he has rushed to break this campaign promise. [..]

Obama was not forced by some extraordinary unforeseen event to accept this tax increase. Obama include this middle class tax increase in his counter offer. Obama didn’t need to do this, he chose to do it.

Right after Obama was re-elected, based on a promise not to raise taxes on the middle class, his first major action was to push for a middle class tax increase. This is a pathological level of dishonesty. The only thing more disturbing is the weak shoulder-shrugging response by most of the media to such a profound act of deception.

So whether the Bush tax cuts expire on Dec 31 or the rate of inflation is calculated by the chained CPI, middle class taxes are going up and SS recipients will be eating cat food.

There are those of us who knew this all along but everyone was focused  on the prospects of a Democratic resurgence that would govern from the left. They were blinded by the bright shiny object that was this man who gave a great speech and had an attractive family. But he came from the roots of Chicago Democratic politics and had an agenda that really wasn’t so hidden. He just lied and everyone believed him even though the facts were right in front of them that Pres. Obama is a right wing, corporatist, Republican and has been flat out lying to us all.

FCC: Merry Christmas, Rupert

The Obama administration’s Federal Communications Commission is on the verge of handing media mogul Rupert Murdoch a very nice Christmas present. Murdoch, who already owns Wall Street Journal, the New York Post, Fox News Channel, Fox movie studios, 27 local TV stations and more, now wants to purchase the Los Angeles Times and Chicago Tribune, that are currently owned by the bankrupt Tribune Company, and a controlling stake in the Yes Network. Julius Genachowski, the F.C.C. chairman, is about to ease the rules to let him.

We were down this road before during the Bush administration and it was roundly rejected, not only by the public, but by Congress and the courts:

Genachowski’s proposal is essentially indistinguishable from the failed Bush administration policies that millions rallied against in 2003 and 2007. Ninety-nine percent of the public comments received by the FCC opposed lifting these rules when the Republicans tried to do it.

Genachowski’s proposal is nearly identical to the one the Senate voted to overturn with a bipartisan “resolution of disapproval” back in 2008. Among the senators who co-sponsored that rebuke to runaway media concentration were Joe Biden and Barack Obama.

At the time, Obama blasted the FCC for having “failed to further the goals of diversity in the media and promote localism,” saying the agency was in “no position to justify allowing for increased consolidation.” Nothing has changed — except which party controls the White House.

The federal courts have repeatedly — and as recently as 2011 — struck down these same rules, noting the FCC’s failure to “consider the effect of its rules on minority and female ownership.” The 3rd U.S. Circuit Court of Appeals ordered the FCC to study the impact of any rule changes before changing the rules. The FCC has done nothing of the kind.

Yet, the Obama FCC now wants to hand control of the news in a media outlet to one man.

Bill Moyers addressed this issue with Sen. Bernie Sanders on why big media shouldn’t get bigger.

In 1983, 50 corporations controlled a majority of American media. Now that number is six. And Big Media may get even bigger, thanks to the FCC’s consideration of ending a rule preventing companies from owning a newspaper and radio and TV stations in the same big city. Such a move – which they’ve tried in 2003 and 2007 as well -would give these massive media companies free rein to devour more of the competition, control the public message, and also limit diversity across the media landscape. On this week’s Moyers & Company (check local listings), Senator Bernie Sanders, one of several Senators who have written FCC Chairman Julius Genachowski asking him to suspend the plan, joins Bill to discuss why Big Media is a threat to democracy and what citizens can do to fight back.

Sanders also expresses his dismay that such a move would come from an Obama appointee. “Why the Obama Administration is doing something that the Bush Administration failed to do is beyond my understanding,” Sanders tells Bill. “And we’re gonna do everything we can to prevent it from happening.”

FCC May Give Murdoch a Very Merry Christmas

Until now, this hasn’t been the best year for media mogul Rupert Murdoch. For one, none of the Republicans who’d been on the payroll of his Fox News Channel – not Newt Gingrich or Rick Santorum or Mike Huckabee or Sarah Palin – became this year’s GOP nominee for president. [..]

But Murdoch’s luck may be changing. Despite Fox News’ moonlighting as the propaganda ministry of the Republican Party, President Obama’s team may be making it possible for Sir Rupert to increase his power, perversely rewarding the man who did his best to make sure Barack Obama didn’t have a second term. The Federal Communications Commission could be preparing him one big Christmas present, the kind of gift that keeps on giving – unless we all get together and do something about it. [..]

In prior years, the FCC has granted waivers to the rules, but this latest move on their part would be more permanent, allowing a monolithic corporation like News Corp or Disney, Comcast, Viacom, CBS or Time Warner – in any of the top twenty markets – to own newspapers, two TV stations, eight radio stations and even the local Internet provider. [..]

Make your voices heard – write or call Genachowski and the other commissioners – you can find their names, e-mail addresses and phone numbers at the website fcc.gov, or on the “Take Action” page at our website, BillMoyers.com. Write your senators and representatives, too, tell them the FCC must delay this decision and give the public a chance to have its opposition known. We’ve done it before.

Just ask the FCC this basic question: What part of “no” don’t you understand?

The Great Debate on the Grand Sell Out of Medicare

Whether you voted for Barack Obama or not, the reality is he is on the same path he was on for the last four years and that is to sell out the majority of Americans to reach a “bargain” with Republicans, who lost the election, on the mythical “fiscal cliff” and the  unconstitutional “debt ceiling.” Part of that sell out is raising the eligibility age for Medicare recipients to 67. This little nugget has started a “great debate” and a bit of an internet dispute about whether or not this is a good, or even workable, idea.

In his article at AMERICAblog our friend Gaius Publius, who is just reporting it, quotes Paul Krugman’s reaction on his NY Times blog to Ezra Klein’s commentary in The Washington Post on Jonathan Chait’s article in The New Yorker, who thinks that raising the eligibility age by two years is an OK idea. What the Herr Doktor said:

Ezra Klein says that the shape of a fiscal cliff deal is clear: only a 37 percent rate on top incomes, and a rise in the Medicare eligibility age. [..]

First, raising the Medicare age is terrible policy. It would be terrible policy even if the Affordable Care Act were going to be there in full force for 65 and 66 year olds, because it would cost the public $2 for every dollar in federal funds saved. And in case you haven’t noticed, Republican governors are still fighting the ACA tooth and nail; if they block the Medicaid expansion, as some will, lower-income seniors will just be pitched into the abyss.

Second, why on earth would Obama be selling Medicare away to raise top tax rates when he gets a big rate rise on January 1 just by doing nothing? And no, vague promises about closing loopholes won’t do it: a rate rise is the real deal, no questions, and should not be traded away for who knows what. [..]

All that effort to reelect Obama, and the first thing he does is give away two years of Medicare? How’s that going to play in future attempts to get out the vote?

If anyone in the White House is seriously thinking along these lines, please stop it right now.

Meanwhile, Chait’s article, Go Ahead, Raise the Medicare Retirement Age, prompted David Dayen’s response at FDL and the Wanker of the Day Award from Atrios.

Dayen’s critique prompted some poutrage from Chait and Ed Kilgore at Washington Monthly, who was more concerned about “tone” than the consequences of raising Medicare’s eligibiliy age.

Which resulted in Dayens’ response to Chait, the ill informed Ezra Klein comment agreeing with Chait that the Affordable Care Act would “blunt the pain,” and a hat tip to Kilgore’s pique about “tone.”

Meanwhile, Karoli at Crooks & Liars gets it in her response to Klein’s interview with Peter Orzag, former director of the Obama Administration’s Office of Management and Budget, currently Vice Chairman of Global Banking at Citigroup:

Listen Up, White House! Take Medicare Eligibility Age Off The Table NOW.:

Raising the Medicare eligibility age is terrible, awful, horrible policy that plays right into the Republicans’ goal of killing Medicare altogether. Obamacare does not change that fact in substantive ways. Here’s why, in bullets:

  • Adverse selection – Obamacare or no Obamacare, raising the eligibility age means people enter the Medicare system with a higher likelihood of health problems. Even if they have health insurance before they’re eligible for Medicare, facts are facts: The older one gets, the more likely health problems become.
  • Administrative costs – Medicare’s administrative costs consistently come out to about 7 percent. Obamacare allows for administrative costs of 15 percent. Extending coverage via Obamacare means higher, not lower, costs to the government and the middle class. Subsidies will cost more for that older group as well as for the younger group, since insurers will set a higher baseline on young people in order to pad reserves for older people because of the 3:1 ratio requirement on rates between youngest and oldest.
  • Workforce phase-outs of older employees – This is the dirty little elephant in the middle of the room that no one talks about. Because of the high demand for jobs right now, older employees are being shoved phased out earlier. Beginning at around age 50 to 55, jobs become scarce for older workers, leaving them with a 10-15 year gap before they become eligible for Social Security and Medicare. That means they’re living on their savings, home equity, or odd jobs just to scratch their way to the social safety net. Moving that football means leaving them on the hook for 2 extra years, not only for living expenses, but also covering their health insurance, whether or not subsidized.

[..]I’ve been told by some pragmatic liberals who I usually agree with that I’m being unreasonable on this point. I beg to differ. It is not reasonable for Peter Orszag to say we’ve gotten a concession from Republicans because privatizing Social Security is off the table entirely. That’s a little like saying we’re really lucky that they’re holding the gun to our hearts instead of our heads. The impact of conceding any ground on Medicare eligibility is immeasurably negative for Democrats.

HELLO, Barack, raising the eligibility age for Medicare is a really bad idea.

A Step in the Right Direction: Ending Indefinite Detention for US Citizens

Shortly after President Barack Obama signed the National Defense Authorization Act on December 21, 2011 a group of journalists and activist joined Pulitzer Prize-winning war correspondent Chris Hedges in a lawsuit against the Obama administration asserting that the law violated free speech and associational rights guaranteed by the First Amendment and due process rights guaranteed by the Fifth Amendment of the United States Constitution. In September U.S. District Judge Katherine Forrest had blocked the disputed statute from the National Defense Authorization Act, essentially declaring it unconstitutional. That ruling was overturned in October by a three-judge panel of the 2nd U.S. Circuit Court of Appeals. It is worth noting that all of those judges were appointed by Barack Obama.

But who would have thought that Hedges and company would have an ally  in Senators Rand Paul (R-KY) and Dianne Feinstein (D-CA) who along with several other senators from both sides of the aisle, filed an amendment to the current military spending bill that would bar detentions of citizens and green card-holders:

Sen. Dianne Feinstein (D-Calif.), who helped write that amendment, declared Wednesday that it is not good enough, and recalled seeing Japanese Americans jailed in horse stalls at a racetrack when she was a girl.

“I believe that the time has come now to end this legal ambiguity, and state clearly, once and for all, that the AUMF or other authorities do not authorize such indefinite detention of Americans apprehended in the U.S.,” Feinstein said.

“The federal government experimented with indefinite detention of U.S. citizens during World War II, a mistake we now recognize as a betrayal of our core values,” she said. “Let’s not repeat it.” [..]

Paul, who adheres to many libertarian positions, noted that the federal government’s “fusion centers” — which are supposed to facilitate the flow of anti-terrorism information — already make recommendations that many people would find objectionable, and if carried to their logical conclusions, could provide basis for jailing just about anyone.

Paul pointed to a report from a center in Missouri: “From this fusion center comes a document that says beware of people who have bumper stickers supporting third party candidates,” Paul said. “Beware of people who believe in stricter immigration laws. Beware of people who support the right to life. They might be terrorists.

“This is an official document,” paul added. “Do we want to give up the right to trial by jury when we’re being told that somebody who keeps food in their basement might be a terrorist?”

The problem that many opponents of the indefinite detention provisions see with it is that it is especially vague, saying only that the military can grab anyone who provides “substantial support” to Al Qaeda or “associated forces.” Those terms are not defined by the law, which is being challenged in the federal courts.

Although President Obama signed the bill he had promised that he would never use it who is to say that he won’t change his mind or another president will use it to silence dissent. Considering the number of promises this president has already broken and his close friendship with Cass Sunstein, who would love nothing more that to criminalize decent, the senate needs to approve this amendment to protect the our constitutional rights.

The “Grand Betrayal” Is Still on the Table

As soon as Barack Obama was reelected the austerians were already clamoring for him to enter into the so-called “Grand Bargain” as the only option to keeping the fragile US economy from going over the mythical “fiscal cliff.” Exit polls showed that voters were most concerned about the economy and jobs. They also indicated that raising taxes on the wealthiest was popular, as was preserving Social Security and Medicare as they currently exist. The debt/deficit was at the bottom of the list of voter interests. There has been much talk from Pres. Obama and the Democratic leadership that they now have a mandate to raise taxes on the 1% and they are willing to “bargain” with the Republicans. The problem is the “bargain” they want to cut would increase the burden on the elderly and those most in need of these programs now and in the future by raising the age requirements and tying cost of living increases to a metric that would decrease the ability of social security recipients to stay above the poverty line.

In an interview with economist Bill Black by Paul Jay at RT News, Prof. Black discusses how the “grand betrayal” and the role of the president and “Third Way” Democrats in the destruction of the social safety net:

The Grand Confusion: The “Fiscal Cliff” is an Austerity Program

Cutting the deficit has been discussed in terms of a moral imperative for the past two-plus years. But now we’ve arrived at a situation where the deficit would get cut a significant amount, and budget analysts make the obvious, inconvenient case that this would throw the economy back into recession. All the alternative explanations from the deficit scolds – a lack of confidence, the threat of higher interest rates – have nothing to do with the fiscal slope. It’s just that it would pull back on federal spending and raise taxes to such a degree that the economy would suffer. [..]

In the hands of someone who didn’t want a bargain on the deficit, this would be the ultimate teachable moment. “All those people telling us for years we have to cut the deficit, suddenly don’t want to cut the deficit,” that leader would say. “They’re warning people of the dangers of cutting the deficit, and saying we have to put a deficit plan together to avoid cutting the deficit!” But Obama wants this deal for his legacy. So he’s not going to disabuse anyone of the confusion over the fiscal slope.

Leaked Woodward Memo Offers Road Map on Grand Bargain

Bob Woodward leaked the deal memo from the proposed 2011 grand bargain, which didn’t happen for a number of reasons, none of them being Barack Obama’s reticence to cut a deal. [..]

This was what the President signed off on, before the Gang of Six embarrassed him by calling for more revenue. He was perfectly willing to not only endorse this deal, but force the Democratic leadership to swallow it as well. And this is why Ryan Grim can be so sure that the next set of talks will include reductions in benefits to the elderly, the poor and the middle class. That’s what happened before, after all. [..]

Any sane observer of economic reality understands that the biggest concern in the near term is that the deficit will end up to small, not too large. We don’t have a deficit problem but a health care cost problem, and it’s not entirely clear we even have that as much as we have a CBO which over-hypes the health care cost problem in their models (the fact that CBO wanted to talk with Naked Capitalism’s Yves Smith for daring to question their model is quite telling). We have countless examples of counter-productive austerity in a time of a slowly recovering economy. [..]

At any rate, we cannot depend on the intransigence of the right this time around. Bill Kristol floated acceptance of higher taxes on the wealthy, following David Koch from a couple months ago. And John Boehner reportedly brought the hammer down with his caucus [..]

Senate Majority Leader Harry Reid has repeatedly stated that “we are not going to mess with Social Security.” The problem Sen. Reid has with keeping Social Security out of any bargain is President Barack Obama who is all to willing to bargain it away for a deal with the Republicans. The argument over the debt/deficit has never been whether taxes will be raised in any bargain, the goal of the right has been to destroy Social Security and cripple Medicare and Medicaid.

President Obama is still pursuing a “grander bargain” that would betray the trust of the people who returned him to office with the hope that he would change.

Obama Reelected: Now What?

Now that Barack Obama has been given a second chance by the electorate, the question becomes what happens next. The “fiscal cliff” still looms, although it isn’t really a “cliff,” more like a slope. The government remains divided with the House still in the hands of fiscal conservatives and the Senate will remain crippled by a recalcitrant minority determined to block any reasonable effort at “compromise” by the Democratic majority and the White House to end the Bush/Obama tax cuts for the wealthiest.

The US markets reacted to the election this afternoon by plummeting to below 13,000 for the first time since August.

Stocks were sharply lower in afternoon trading in New York, with both the Standard & Poor’s 500-stock index and the Dow Jones industrial average down 2.3 percent, as European shares sank and Asian stocks were mixed. While many executives on Wall Street and in other industries favored Mitt Romney, many had already factored in the likelihood of Mr. Obama winning a second term.

Still, continued divided government in Washington and little prospect for compromise unnerved traders. [..]

Companies in some sectors, like hospitals and technology, could see a short-term pop, said Tobias Levkovich, chief United States equity strategist with Citi. Other areas, like financial services as well as coal and mining, could be hurt as investors contemplate a tougher regulatory environment.

Fears of the fiscal impasse and the continued euro crisis were just some of the reasons but more than anything it was the failure of the GOP to take back the White House and Senate to secure the fraudsters fiefdom. It was fairly obvious from some headlines that Elizabeth Warren’s election to the Senate has Wall St. very upset: Wall Street Scourge Warren Entering U.S. Senate.

Democrat Elizabeth Warren, whose attacks on Wall Street propelled her ascent, will become the first female U.S. senator from Massachusetts, entering a divided chamber that had spurned her appointment as the nation’s consumer-protection chief.

I doubt they will be able to get rid of her as easily as they got rid of the “Sheriff of Wall St.,” former New York governor Elliot Spitzer.

I highly doubt that House Speaker John Boehner (R-OH), Senate Minority Leader Mitch McConnell (R-KY) and extremist Tea Party members are going to be any more cooperative with the White House and the Democratic majority in the Senate. In fact, it was already looking like they were digging immediately after the President’s victory speech with Mr. Boehner stating that the GOP’s retaining of the House majority meant that there was no mandate to raise taxes. Sen. McConnell echoed those sentiments telling the President that he shouldn’t consider the Democratic Senate wins as too much of a mandate.

To break at least the Senate deadlock, it is well past time to do something about the filibuster, which the Republicans have used in record numbers, over the last four years to block any progress for economic recovery the Democratic wins as too much of a mandate. During the campaign, Gov. Mitt Romney tried to revise history saying that Pres. Obama got everything he wanted and still failed

The argument obscures the important policy-making role Republicans had in the first two years of Obama’s presidency, when they used a record number of filibusters in the Senate to weaken – and in some cases thwart – large pieces of his agenda.

The $787 billion stimulus package in 2009, which was ultimately too small to fully reverse the economic downturn, had to be scaled down because a GOP filibuster required Democrats to win over 60 Senate votes for final passage. Repeated filibusters on health care reform ate up nearly a year of the Democrats’ legislative time, and Obama’s subsequent efforts to boost the economy were met with the same wall of Republican opposition – one that became insurmountable after the GOP’s congressional victories in 2010.

Progressives argue that the economy continues to struggle in part because Republicans have blocked Obama’s efforts, and advanced an agenda in 2011 and 2012 that effectively – if not intentionally – sabotaged the recovery.

Sen. Harry Reid (D-NV), who will likely remain majority leader, has vowed once again to address the problem of the filibuster

Senate Majority Leader Harry Reid (D-Nev.) pledged on Wednesday to change the rules of the Senate so that the minority party has fewer tools to obstruct legislative business.

In his first post-election press conference, the Nevada Democrat said he wouldn’t go so far as to eliminate the filibuster, which requires 60 votes for the chamber to enter and exit the amendment and debate process. But in remarks meant to preview a more combative approach during the next session, he warned Republicans that obstructionism as a tactic won’t be tolerated — or as technically feasible.

The problem is what Sen. Reid, who has stated that he supports filibuster, proposes does not go far enough:

“The first thing is the most important thing,” Reid said the interview. “Do away with motion to proceed. Just do away with it. I favor the filibuster. There’s a reason for the filibuster. I understand it. It’s to protect the rights of the minority. The Senate was set up to protect the rights of the minority … so that’s the no. 1 issue, and the rest of the stuff we can deal with if there’s a filibuster conducted. Those are the kind of things — if we get the motion to proceed out of the way, we can debate it, one, to cloture. That’s good. So that’s the no. 1 biggie.”

Even with Democrats set to control the Senate — indeed, even set to expand their current majority — the avenues for Reid to pursue rules reform aren’t entirely clear.

There has historically been some debate over whether the majority can change the Senate rules at the beginning of each term, or whether two-thirds support is needed, per the Senate rules. The question hinges on whether the Senate is a “continuing legislative body” or whether each new term marks a new Senate. Those who want to change the rules using a majority vote argue that past Senates cannot bind the hands of future legislative bodies.

Whatever the historical record, the basic fight comes down to numbers. No matter what the Senate chair rules, a majority can overrule the chair. However, that will likely be unnecessary, as Vice President Joe Biden is known to be a supporter of filibuster reform, and a believer that the constitution allows the majority to write new rules at the start of a term.

While some of the Republicans say they will reflect on their inability to achieve their goal, perhaps it’s time for the Democrats to do the same in the Senate and replace Harry Reid with someone who will stand up to Mitch McConnell, John Boehner and the Tea Party bullies.
