Big news form Newsweek on Attorney General Eric Holder

    Holder, 58, may be on the verge of asserting his independence in a profound way. Four knowledgeable sources tell NEWSWEEK that he is now leaning toward appointing a prosecutor to investigate the Bush administration’s brutal interrogation practices, something the president has been reluctant to do. While no final decision has been made, an announcement could come in a matter of weeks, say these sources, who decline to be identified discussing a sensitive law-enforcement matter. Such a decision would roil the country, would likely plunge Washington into a new round of partisan warfare, and could even imperil Obama’s domestic priorities, including health care and energy reform. Holder knows all this, and he has been wrestling with the question for months. “I hope that whatever decision I make would not have a negative impact on the president’s agenda,” he says. “But that can’t be a part of my decision.”

  In the telling and masterfully written article, much of the personality of AG Eric Holder is revealed. Apparently, if the Obama/Biden Administration was planning on whitewashing the crimes of the last Administration, they picked the wrong guy. Holder exhibits a strong character and a legal mind that is no enemy of the rule of law. Rather, he is a huge threat to the politicized executive branch, in particular the branches previously controlled by Dick Cheney, Donald Rumsfeld and Scooter Libby, among other war criminals. I strongly suggest that everyone who demands justice and equality as the main course of their Democracy (D) give this article a long hard read, better yet two.

  Now is the time to demand change.

Well if you guessed, you were right.

  On the heels of this news comes the story in today’s New York Times


The Central Intelligence Agency withheld information about a secret counterterrorism program from Congress for eight years on direct orders from former Vice President Dick Cheney, the agency’s director, Leon E. Panetta, has told the Senate and House intelligence committees, two people with direct knowledge of the matter said Saturday.

Quoting Newsweek further

    Still, Holder couldn’t shake what he had learned in reports about the treatment of prisoners at the CIA’s “black sites.” If the public knew the details, he and his aides figured, there would be a groundswell of support for an independent probe. He raised with his staff the possibility of appointing a prosecutor. According to three sources familiar with the process, they discussed several potential choices and the criteria for such a sensitive investigation. Holder was looking for someone with “gravitas and grit,” according to one of these sources, all of whom declined to be named. At one point, an aide joked that Holder might need to clone Patrick Fitzgerald, the hard-charging, independent-minded U.S. attorney who had prosecuted Scooter Libby in the Plamegate affair. In the end, Holder asked for a list of 10 candidates, five from within the Justice Department and five from outside.

   So, to top off the last few days, Bush/Cheney was exposed as covering up 2,000 P.O.W. deaths in Afghanistan, the Bush/Cheney CIA was accused of lying to the Legislative branch since 2001, Dick Cheney is accused of having given the Executive branch order to the CIA to lie before Congress, and Eric Holder is looking for applicants for the opening position at Special Prosecutor.


   The goal is to wake people up and demand justice, equality and the freedom to pursue happiness.

   Any karma gained during the experience is just a bonus.

  2. faith? It is still to early to know for sure, but I have been consistent in saying I thought the AG would ultimately have to do it for rule of law reasons.

    Emanuel and other administration officials could see that the politics of national security was turning against them. When I interviewed a senior White House official in early April, he remarked that Republicans had figured out that they could attack Obama on these issues essentially free of cost. “The genius of the Obama presidency so far has been an ability to keep social issues off the docket,” he said. “But now the Republicans have found their dream…issue and they have nothing to lose.”

    Time to start chargin’.

    This depiction of Holder and the Justice Department acting at cross purposes to a White House that wanted to keep a lid on past abuses of the Bush Administration neglects the fact that they have in many cases openly facilitated such a cover-up in court filings. The DoJ has consistently invoked the state secrets privilege to shut down lawsuits, tried to keep various records from the past secret, advocated for things like preventive detention and post-acquittal detention, and so on.

    Certainly Yell Louder! But don’t get your hopes up too high that a Special Prosecutor will happen – at least without extreme amounts of Yelling. 🙂

  4. this was never my brand of hardcore I think it applies. Its about staying strong in the face of adversity and all that. And having faith in what you are doing and who you are. Speaking of yelling.

After the Downing Street Minutes were revealed, the disclosure that Cheney made 14 visits to CIA headquarters, and his previous history of using the CIA, I think the MO is well established: Use the “clandestine” departments of the executive branch to illegimately gain political clout and power and hide the evidence using state’s secrets decree.

    In 1975, Rumsfeld and Cheney stage-managed a Cabinet purge called the “Halloween massacre” that made Rumsfeld secretary of defense and Cheney White House chief of staff. Kissinger, forced to surrender control of the National Security Council, angrily drafted a letter of resignation (which he never submitted). Rumsfeld and Cheney helped convince Ford, who faced a challenge for the Republican nomination from Ronald Reagan, that he needed to shore up his support on the right and that Rockefeller was a political liability. Rockefeller felt compelled to announce he would not be Ford’s running mate. Upset at the end of his ambition, Rockefeller charged that Rumsfeld intended to become vice president himself. In fact, Rumsfeld had contemplated running for president in the future and undoubtedly would have accepted a vice presidential nod.

    In the meantime, Secretary of Defense Rumsfeld undermined the negotiations for a new Strategic Arms Limitation Treaty being conducted by Kissinger. Fighting off Reagan’s attacks during the Republican primaries, Ford was pressured by Cheney to adopt his foreign policy views, which amounted to a self-repudiation. At the Republican Party Convention, acting as Ford’s representative, Cheney engineered the adoption of Reagan’s foreign policy plank in the platform. By doing so he preempted an open debate and split. Privately, Ford, Kissinger and Rockefeller were infuriated.

    As part of the Halloween massacre Rumsfeld and Cheney pushed out CIA director William Colby and replaced him with George H.W. Bush, then the U.S. plenipotentiary to China. The CIA had been uncooperative with the Rumsfeld/Cheney anti-détente campaign. Instead of producing intelligence reports simply showing an urgent Soviet military buildup, the CIA issued complex analyses that were filled with qualifications. Its National Intelligence Estimate on the Soviet threat contained numerous caveats, dissents and contradictory opinions. From the conservative point of view, the CIA was guilty of groupthink, unwilling to challenge its own premises and hostile to conservative ideas.

    The new CIA director was prompted to authorize an alternative unit outside the CIA to challenge the agency’s intelligence on Soviet intentions. Bush was more compliant in the political winds than his predecessor. Consisting of a host of conservatives, the unit was called Team B. A young aide from the Arms Control and Disarmament Agency, Paul Wolfowitz, was selected to represent Rumsfeld’s interest and served as coauthor of Team B’s report. The report was single-minded in its conclusion about the Soviet buildup and cleansed of contrary intelligence. It was fundamentally a political tool in the struggle for control of the Republican Party, intended to destroy détente and aimed particularly at Kissinger. Both Ford and Kissinger took pains to dismiss Team B and its effort. (Later, Team B’s report was revealed to be wildly off the mark about the scope and capability of the Soviet military.)

    The only question I have is how many other government departments are now involved in illegal activity for profit and where does the money go? (i.e. IRS- illegal immigration, Defense Department- illegal campaign finance, Agriculture – kickbacks from CAFO’s etc.)
